INTERLOCAL AGREEMENT
THIS INTERLOCAL (INTERGOVERNMENTAL) Agreement ("contract") is entered into by and
between the Governmental Entities shown below as"Contracting Parties,"pursuant to the authority
granted and in compliance with the provisions of the Texas Government Code, Chapter 791, the
"Interlocai Cooperation Act."

II. Services to be performed:
As listed in Attachment A
Ill. Contract Amount:
Forest Hill and Fort Worth agree to reimburse each other for actual cost, including
but not limited to, all disposable items and equipment used beyond a normal fire
and/or emergency medical responses.
IV. Attachments:
The following Attachments are incorporated into this Agreement, and the terms and
conditions shall be binding on the parties to this Agreement, as if set out in full
herein.

V. Term of Contract:
The term of this contract shall be for one year beginning May 1, ewm
automatically for additional one-year periods. Provided, h ever, that it may be

terminated on sixty days notice in writing by either party.
VI. Liability
Any civil liability shall be determined pursuant to the terms of Texas Government
Code 79 1.006.
VII. Independent contractor:
Each Party shall operate under this contract as an independent contractor, and
not as an agent, representative, servant or employee of the other. Subject to the
terms of this contract, each Party shall have the right to control the details of its
performance hereunder.

Any and all payments arising under this contract for the performance of

ATTACHMENT "A"
To the Fort worth-Forest Hill Interlocal Agreement for Fire Mutual Aid
I. AUTOMATIC AID RESPONSE
Explanatory note: Upon receipt of the report of an incident requiring response in their
own respective cities, the Fort worth and Forest Hill fire departments may normally
dispatch the level of resources described in Section l.A below to the reported location.
For purposes of this agreement, automatic aid in the amount of resources described will
be dispatched by one city into the other city's jurisdictional limits or ETJ, if the incident is
reported in any of the geographical areas listed below.
A. Forest Hill:
The Forest Hill Fire Department will dispatch a minimum of one (1) engine or quint
company with a minimum staffing of 3 personnel and one chief officer to the specified
areas in Fort worth listed below:
Mapsco quadrants:
92 E, K, L, M, R
93 T, U, Q, P, N, w, X, Y
106 B, C, D
107 Al B, C
II. MUTUAL AID RESPONSE (non-automatic)
A. Fort Worth:
Hazmat response and Technical Rescue response per Fort worth Fire Department
standard operating procedures will be activated upon notice and request from Forest Hill
that a hazardous material or technical rescue situation exceeds Forest Hill's response
capability and presents a significant threat to life-safety or property.
Calls for assistance during "working" structure fires shall be given on an "as needed
basis", yet shall not exceed a normal one-alarm assignment as described by the Fort
Worth Fire Department.
All such responses are subject to availability of personnel and equipment.

B. Forest Hi!!:
Upon request and notification by Fort Worth, Forest Hill will dispatch one brush truck
and one engine/quint to Fort Worth for assistance on brush fires.
Calls for assistance during "working" structure fires shall be given on an "as needed
basis" by Forest Hill and shall include one engine/quint and one Chief officer.
All such responses are subject to availability of personnel and equipment.
ATTACHMENT "B"
To the Fort Worth-Forest Hill Interiocal Agreement for Fire Mutual Aid
Operating Provisions
i. Any dispatch of equipment and personnel pursuant to this Agreement is subject to the
following conditions:
A. Any request for aid hereunder shall include a statement of the amount and type of
equipment and number of personnel that are needed, but the amount and type of
equipment and number of personnel to be furnished shall be determined by a
representative of the responding city. Forest Hill would provide a fire company
that would be equivalent to the same standards used in Fort Worth.
B. In the event that the responding city is unable to respond to the request for
assistance, the fire chief or designee of the responding city shall immediately
notify the fire department of the requesting city that no response can be made.
C. Personnel from the Fire Department of the responding city shall report to the
officer in charge of the requesting city at the location to which the equipment are
dispatched and shall be subject to the orders of that official. Representatives
from both Forest Hill and Fort Worth will staff the command post so that a "unified
command" is established.
D. The officer in charge from the requesting city shall release personnel from the
Fire Department of the responding city when the services of the responding city
are needed within the area for which it normally provides fire protection.
E. Failure to implement and utilize a working accountability system in accordance to
NFPA guidelines in either party's jurisdictions shall be cause for immediate
release of Mutual/Automatic Aid companies and notification of such actions made
directly to the Department chief.
II. All equipment used by the responding Fire Department in carrying out this Agreement will, at
the time of action hereunder, be owned by it. _

Automatic/Mutual Aid Agreement between the City of Fort Worth Fire Department and the City of
Forest Hill Fire Department
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to enter into a Mutual/Automatic Aid
Agreement for fire protection with the City of Forest Hill Fire Department.
DISCUSSION:
Mutual aid is an agreement between two or more fire departments to respond to formal requests for
assistance under specified conditions. Automatic aid is an agreement between two or more cities where,
upon notification from a requesting city, participating communities will automatically respond based on a
predetermined level of assistance.
Neighboring fire departments often enter into automatic or mutual aid agreements to augment emergency
response resources at major incidents or to gain emergency response in difficult-to-cover areas within a
jurisdiction.
The proposed Mutual/Automatic Aid Agreement between the City of Fort Worth Fire Department and the
City of Forest Hill Fire Department allows for immediate mutual or automatic aid assistance upon the
request of either department in incidents requiring fire protection, hazardous materials (HAZMAT)
mitigation, or technical rescue that may occur in any portion of the areas designated in the agreement.
Automatic Aid Response
Under the terms of the automatic aid section of the proposed agreement, the Forest Hill Fire Department
will dispatch one engine company to the following Fort Worth Mapsco coordinates upon receipt of a report
of an incident requiring such response:

Mutual Aid
Fort Worth will provide Forest Hill hazardous materials response and technical rescue response under the
mutual aid terms of the proposed contract upon notice and request from Forest Hill that a HAZMAT or
technical rescue situation exceeds Forest Hill's response capability and presents a significant threat to life,
safety or property. All such responses are subject to availability of personnel and equipment.

Upon request and notification by Fort Worth, Forest Hill will dispatch one brush truck and one quint to Fort

equipment.
Under the terms of this agreement:
• The term of the contract is one year, renewing automatically for additional one-year periods; and
• Either party may terminate the agreement upon a 60-day written notice given to the other party;
and
• Any civil liability shall be determined pursuant to the terms of Texas Local Government Code 791.006;
and
Fort Worth and Forest Hill agree to reimburse each other for actual costs, including but not limited to, all
disposable items and equipment used beyond normal fire and/or emergency medical responses.
FISCAL INFORMATIONMERTIFICATION:
The Finance Director certifies that this agreement will have no material effect on City funds.
