Contract executed between Tiburon,Inc.and the City of Fort Worth., System Implementation Agreement,Dated May.7, 2004(Exhibit 4 to System-Implementation Agreement,Milestone Payment Schedule)and identified as City Secretary Contract No.29948 LAgreement) Dear Melony: Tiburon,Inc.is pleased to present the Fort Worth Police Department(hereinafter,referred to as the "Client')with this Enhancement Proposal to add the Warrant Tracking Module to the Fort Worth Police Department's Records Management System(RMS)(hereinafter,referred to as the"Proposal"). This Enhancement Proposal is being offered to the Fort Worth Police Department as a sole source opportunity since the integrated Warrant Module to the RMS which performs the functions listed in this enhancement proposal is only available from Tiburon. Scove Description and Responsibilities The attached Exhibit 1, Statement of Work describes in detail each project task and associated completion criteria and the responsibilities for each party. Price Description 1) Proposal firm fixed price: $14,861 2) The Tiburon Annual Maintenance Fee will increase by the following amount as a result of this Proposal: $0. 3) This Proposal does not include any taxes. The client is a tax EXEMPT entity and shall not be subject to any taxes pursuant to the enhancement. Effective Date and Payment Schedule Mrs. Melony Ebel Fort Worth Police Department Enhancement Proposal (EP)--273969C: Warrant Module Page 2 of 4 1) The work described herein will be scheduled to commence at a mutually agreeable date after Client's acceptance of this Proposal. 2) Payment Schedule: • 50% Upon Tiburon receipt of the signed acceptance of this Proposal. • 50% Upon Client's final acceptance of the work performed hereunder. 3) Travel or on-site time is not included in this Enhancement Proposal. 4) Client's acceptance of this Proposal in the signature block provided below, authorizes Tiburon to proceed with the work described herein and confirms funding will be obligated. Any requisite contractual documents required by Client's purchasing procedures are the responsibility of the Client. 5) Upon execution by client,this enhancement proposal shall be incorporated into and governed by the terms and conditions of the Agreement referred to herein. The terms and conditions of the Reference Agreement, Contract executed between Tiburon Inc. and the City-of Fort Worth System Implementation A reement Dated May 7 2004 Exhibit 4 to S stem Im lementation Agreement, Milestone Pa meat Schedule and identified as City Secretary Contract No.29948 (Agreement), and this Proposal prevail regardless of any conflicting or additional terms and conditions on any Purchase Order or other correspondence. Any contingencies or additional terms obtained on any Purchase Order are not binding upon Tiburon. All Purchase orders are subject to approval and acceptance by Tiburon. 6) This fixed price Proposal is valid through September 30,2009, unless otherwise modified by Tiburon in writing prior to Client's acceptance. The Warrant System processes and stores Warrants,and produces reports showing warrant activity, status,and aging.This module may interact with local, state, and federal databases,The system is designed to provide centralized management of warrant storage and processing. Tiburon Responsibilities I)Install the Warrant Tracking module into the Fort Worth RMS test system. 2)Configure the Warrant Tracking module for Fort Worth Police Department use. 3) Provide one(1) electronic copy of the Warrant Tracking module documentation(Tiburon current format and media at the time of delivery). 4)Provide two(2)hours of remote Warrant Module training. 5)Place the Warrant Tracking module into production use. Client Responsibilities l) Designate a person to be the principal point of contact for all technical questions and administrative arrangements relating to this Enhancement Proposal. 2) Provide VPN access to Tiburon development personnel. 3} Schedule students to attend the training(maximum of eight(8) students). 4) Ensure that scheduled students are able to attend the course for its complete duration. 5) Test the module for conformance to the baseline specification(provided by Tiburon). Completion Criteria This work will be considered complete ten(1 0)business days after Tiburon has provided the Client with written notification that the module is ready for testing in the test system, or the module has been placed into production, whichever comes first. If Client does not confirm completion with a sign off letter presented by the Tiburon project manager within ten(1 0)business days of submittal of such letter,or otherwise notifies Tiburon in writing why completion sign-off has not been provided any final invoice(s) will be issued and will be payable in accordance with the payment terms of this Enhancement Proposal. RECOMMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to execute an enhancement to City Secretary Contract No. 29948 with Tiburon, Inc., in the amount of$14,861.00 for the purchase of the Warrant Tracking Module to be utilized with the Fort Worth Police Department's Records Management System; and 2. Increase the amount not to exceed under City Secretary Contract No. 29948 to an estimated $112691712-00. DISCUSSION: On May 7, 2004, the City of Fort Worth entered into a Software Licensing Agreement with Tiburon Inc., (Tiburon) under City Secretary Contract(CSC) No. 29948 for the implementation of a Records Management System for the Police Department. Since implementation of the RMS, the Police Department has learned that Tiburon offers a Warrant Tracking Module that would move the current warrant system from the antiquated mainframe and improve the return time on wanted person's information and warrant confirmations. As the City's IT Solution's Department decommissions the mainframe, this requested software will ensure that the Police Department has a viable warrant tracking solution for the future. The cost of purchasing the Tiburon Warrant Tracking Module along with one year of support is $14,881.00, CSC No. 29948 was authorized for an amount not to exceed $1,254,851.00; therefore, adding this Warrant Tracking Module will increase the amount not to exceed under CSC No. 29948 to an estimated $1,269,712-00.
