HomeMy WebLinkAboutContract 56908-A1 AMENDMENT NO. 1 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES FOREST PARK ENFAC STATE OF TEXAS CITY SECRETARY CONTRACT NO. 56908-A1 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Brinkley Sargent Wiginton Inc., (Consultant) made and entered into City Secretary Contract No. 56908 (The Contract) which was authorized by the City Council by M&C 22-.694, the 13th day of September, 20, for FORT WORTH FOREST PARK AQUATIC CENTER, SERVICES AND COMPENSATION; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for additional design services for Design Development, Construction Documents and Administration. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional design services for the design and detailing of Fort Worth Forest Park Aquatic Center, Services and Compensation. The cost of this additional service is $879,620.00 including reimbursable expenses. The scope of services is described more fully in Brinkley Sargent Wiginton's Letter dated April 2022, subject: "Fort Worth Forest Park Aquatic Center, Services and Compensation". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "A". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "A". However the total fee paid by the City shall not exceed a total of $979,520.00 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." A. BASIC A/E SERVICES(DESIGN DEVELOPMENT THROUGH COMPLETION): $511,000 (Based upon"Deck Level Option" scope of work presented at March 2022 public meeting) Basic Services Includes: • Architecture • MEP Engineering(MWBE subcontract) • Structural Engineering(MWBE subcontract) • All Services Noted Below • Fees to be billed monthly by percent as follows: i. Construction Administration 20% The budget may be adjusted from time to time by City of Fort Worth's authorization. Should the City increase the construction budget as a result of increased scope of work the Architect will receive a fee adjustment equal to 8%of the budget increase. AQUATIC ENGINEERING: Swimming pool engineering services include services from Design Development phase through completion. Services include providing pool layouts, sections, dimensional control,pool mechanical systems design,piping plans, specifications, and related details and construction administration. Includes specification of pool related equipment. ($208,350) *CIVIL ENGINEERING: Civil engineering services include providing demolition plan, site horizontal control, utility plan, paving plan, grading plan, erosion control plans, and related details and construction administration. Does not include off-site engineering. ($49,000) *PLATTING: Re-plat of site to incorporate project improvements. ($14,000) GEOTECHNICAL RECOMMENDATIONS: Field investigation and development of geotechnical design recommendations governing foundation designs. ($10 600) LANDSCAPE DESIGN SERVICES: Services shall include selection of plant material, flatwork design/details and design of irrigation system as well as providing assistance in the bidding and contract administration of these elements. ($4,000) INTERIOR DESIGN SERVICES: Interior finish selection,presentation, specifications, and shop drawing review services will be provided by Brinkley Sargent Wiginton Architects. ($20,000) *ACCESSIBILITY CONSULTING SERVICES: Review of documents by state-approved firm for conformance. Site visits for substantial completion and final state required inspection are included. All State of Texas required submittal fees are included in this contract except submittal fee. ($2,530) **AS-BUILT DOCUMENTS: Prepare an electronic version of drawings showing significant changes in the work during construction from data furnished by Contractor. ($11,740) **Portions of these services are provided by MWBE subcontracts. *COMMISSIONING: Basic commissioning services for 2015 IECC compliance. Does not include test and balance,which will be by Contractor. ($6,400) EXCLUDED SUPPLEMENTAL SERVICES ARE AS FOLLOWS: TECHNOLOGY DESIGN: Low voltage design will be provided by Owner. Such systems include structured cabling, audio/visual,security and access controls. Owner shall provide timely design data and direction as required for the design team to include raceway in the electrical documents. EQUIPMENT,FURNITURE SELECTIONS AND PROCURMENT: Assist in the selection, specification &procurement of equipment and furnishings is excluded,other than as stated above. FOOD SERVICE DESIGN SERVICES: Food service design is excluded. This proposal does not anticipate any regulatory submittals regarding approved use. 2. Bidding and design will be executed using a single-phase construction approach and traditional CMAR procurement method. 3. Cost estimating services is excluded beyond review of estimates provided by CMAR. Any re-design costs related to inaccurate estimates will be additional services. 4. Bathhouse size is approximately 3,000 sf, single story,as per approved program. 5. Pool mechanical size is approximately 1,250 sf,utilizing a pre-engineered metal building approach. 6. Fee excludes LEED or similar certification. 7. Fee excludes historical preservation,documentation or related submittals. 8. Contract Administrative site observation services are based on an average of twice monthly site visits. Note: If construction activities extend past 13 months through no fault of the architect,the architect shall have right to seek additional services at a rate of$3,000/month for extended construction administration services through completion of project close-out. Authorize execution of a Construction Manager at Risk contract with Steele & Freeman, Inc. in the amount not to exceed $9,497,625.00, including an owner's construction contingency allowance, for the Forest Park Pool replacement project. DISCUSSION: The Forest Park Pool Replacement project is included in the 2022 Bond Program and will replace the existing pool and support facilities. In order to start the design process, a Request for Qualifications was advertised in the Fort Worth Star-Telegram in August of 2021. The City of Fort Worth received eleven proposals from design teams. These included; Bennett Partners, Brandsetter Carroll, Brinkley Sargent Wiginton Architects, Dunaway Associates, EIKON Consulting Group, Fender/Andrade Architects, GFF, Kimley-Horn &Associates, LPA, Oxley Williams Tharp Architects, and RPGA Design Group. On October 4, 2021, a selection team composed of members of the Park& Recreation Department, Property Management Department, and Diversity & Inclusion Department, carefully reviewed these submittals and after discussion and scoring, were able to establish a shortlist of three highly qualified teams. These three teams were Brandsetter Carroll, Brinkley Sargent Wiginton Architects, and Kimley- Horn &Associates. Interviews were held on October 20, 2021. The selection team had an opportunity to meet the design teams and discuss the project. While all three were certainly qualified, the interviews and scoring indicated that Brinkley Sargent Wiginton, Inc. was the most qualified for this particular project. PROJECT TOTAL F$111900,000.00 It was determined that the Construction Manager at Risk (CMAR) would be the best delivery method. Once a scope of work and initial budget was defined, a Request for Qualifications was advertised in the Fort Worth Star-Telegram on September 23, 2021 and September 30, 2021. The City of Fort Worth received five proposals from CMAR contractors (Hill &Wilkerson General Contractors, McGough Construction, Reeder General Contractors, Inc., Steel & Freeman, Inc., and Tegrity Contractors, Inc.). A selection team composed of members of Park& Recreation Department, Property Management Department, and the Office of Business Diversity carefully reviewed these submittals and after scoring and much discussion were able to establish a shortlist of four highly qualified teams. After ranking the proposals and conducting interviews, the selection team determined that the Steele & Freeman Inc. proposal offered the best value to the City. Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund, in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election. Waiver of Building Permits - In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non-City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived. Business Equity — Brinkley Sargent Wiginton Architects, Inc. is in compliance with the City's Business Equity Ordinance by committing to 19\% Business Equity participation on this project. The City's Business Equity goal on this project is 14\%. Steele-Freeman, Inc. is in compliance with the City's Business Equity Ordinance by committing to 25\% Business Equity participation on this project. The City's Business Equity goal on this project is 25\%. Forest Park Pool is located in COUNCIL DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval and adoption of the 2022 Bond Program Fund appropriations by City Council, funds will be available in the current capital budget, as appropriated, in the 2022 Bond Program Fund and the Tax Note 2021 C Fund for the Forest Park ENFAC project to support approval of the above recommendations, execution of the amendment to the agreement and contract. Prior to any expenditure being incurred, the Park & Recreation has the responsibility to validate the availability of funds.
