AUTHORIZING AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION IN THE APPROXIMATE AMOUNT OF
$555,791.00, WITH FEDERAL PARTICIPATION IN THE AMOUNT OF $335,125.00,
STATE PARTICIPATION IN THE AMOUNT OF $23,653.00 AND LOCAL
PARTICIPATION IN THE AMOUNT OF $197,013.00, FOR ENGINEERING,
ENVIRONMENTAL SERVICES AND CONSTRUCTION OF RAMEY AVENUE AT
STALCUP ROAD HIGHWAY SAFETY IMPROVEMENT PROJECT
WHEREAS, federal law establishes federally funded programs for transportation improvements
to implement its public purposes, and
WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall
design, construct and operate a system of highways in cooperation with local governments, and Section
222.052 authorizes the Texas Transportation Commission to accept contributions from political
subdivisions for development and construction of public roads and the state highway system within the
political subdivision, and
WHEREAS, federal and state laws require local governments to meet certain contract standards
relating to the management and administration of State and federal funds, and
WHEREAS,the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that
describe federal, state, and local responsibilities for cost participation in highway improvement and other
transportation projects, and
WHEREAS, the Texas Transportation Commission passed Minute Order Number 115814
authorizing the State to undertake and complete a highway improvement or other transportation project
generally described as construct new roadway lanes; and
WHEREAS, the City of Fort Worth identified the need to signal rebuild including Accessible
Pedestrian Signal (APS), construct American with Disabilities Act (ADA) ramps, add left turn lanes for
northbound/southbound/eastbound/westbound, install Flashing Yellow Arrow (FYA) for
northbound/southbound/eastbound and westbound left turn lanes, refresh pavement markings and add
advance signal warning signs; and
WHEREAS, the City of Fort Worth and Texas Department of Transportation have
negotiated terms of an Advance Funding Agreement in the approximate amount of
$555,791.00, with federal participation in the amount of$335,125.00, state participation in
the amount of $23,653.00 and local participation in the amount of $197,013.00.00, for
engineering, environmental services and construction of Ramey Avenue at Stalcup Road
highway safety improvement project improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, THAT:
The City Manager is hereby authorized to execute an Advance Funding Agreement
with the Texas Department of Transportation (CSJ: 0902-90-21 1) in the approximate amount
of $555,791.00, with federal participation in the amount of $335,125.00, state participation
in the amount of $23,653.00 and local participation in the amount of $197,013.00, plus cost
overruns, for engineering, environmental services and construction of Ramey Avenue at
Stalcup Road highway safety improvement project improvements.
Adopted this 1 lch day of October 2022.

Amend the Fiscal Years 2022-2026 Capital Improvement Program(2018 Bond Program)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Resolution authorizing execution of an advance funding agreement with the Texas Department of Transportation in the
amount of$555,791.00 with federal participation in the amount of$335,125.00,State participation in the amount of$23,653.00 and local
participation in the amount of$197,013.00 for the Ramey Avenue at Stalcup Road Highway Safety Improvement project(City Project
No. 103635);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Other Fund,
subject to receipt of the grant, in the amount up to$372,361.00 for the Ramey Avenue at Stalcup Road Highway Safety Improvement project
(City Project No. 103635);and
3. Amend the Fiscal Years 2022-2026 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C)is to adopt a resolution authorizing execution of an Advance Funding Agreement
(AFA)with the Texas Department of Transportation(TxDOT)in the amount of$555,791.00,of which$197,013.00 is City of Fort Worth's(City)
participation and authorize acceptance of federal grant funds in the amount of$335,125.00 for construction of the Ramey Avenue at Stalcup Road
Highway Safety Improvement project(City Project No. 103635).
The scope of this project includes signal rebuilds that include Accessible Pedestrian Signals(APS), construction of American with Disabilities Act
(ADA)ramps,addition of left turn lanes for northbound/southbound/eastbound/westbound traffic,installation of Flashing Yellow Arrows(FYA)for
northbound/southbound/eastbound and westbound left turn lanes,refreshing of pavement markings and the addition of advance signal warning
signs at the intersection of Ramey Avenue at Stalcup Road.
This project will be led by TXDOT in June 2023. The State is responsible for all construction activities within the scope of this project. The State
will be responsible for securing the federal and State share of the funding required for the development and construction of the project. City funds
have been appropriated to this project for design, right-of-way,utilities and project management costs.The City bears the responsibility to pay for
cost overruns. At the end of the project,the asset will remain with the City of Fort Worth.

Funding for this project was not included in the FY2022-2026 Capital Improvement Program(CIP)due to the project originated after the CIP was
adopted. The action in this M&C will amend the FY2022-2026 Capital Improvement Program as approved in connection with Ordinance 25073-
09-2021.
This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt
is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No.23209-05-2018)
and subsequent actions taken by the Mayor and Council.
Funding for the required City participation will be from the 2018 Bond Program,2007 CritCapProj Fund&Street Improvements Fund of which a
portion of this funding will be appropriated to the project in a separate M&C.

FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds
will be available in the current capital budget,as appropriated, in the Grants Capital Project Other Fund.The Transportation and Public Works
Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City. Prior to expenditure
being incurred,the Transportation&Public Works Department has the responsibility to validate the availability of funds.This is reimbursement
grant.
