HomeMy WebLinkAboutResolution 5640-10-2022 A Resolution NO. 5640-2022 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $526,900.00, OF WHICH CITY PARTICIPATION IS APPROXIMATELY $504,004.00, FOR PROFESSIONAL SERVICES AND ENGINEERING TO WIDEN LAS VEGAS TRAIL FROM TWO LANES TO FOUR LANES FROM INTERSTATE HIGHWAY 820 TO APPROXIMATELY QUEBEC DRIVE WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes, and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision, and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds, and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects, and WHEREAS, the Texas Transportation Commission passed Minute Order Number 115814 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as construct new roadway lanes; and WHEREAS, the City of Fort Worth identified the need to widen Las Vegas Trail from IH 820 to approximately Quebec Drive with intersection, traffic signal, pedestrian and stormwater channel improvements; and WHEREAS, the City of Fort Worth and Texas Department of Transportation have negotiated terms of an Advance Funding Agreement in the Amount of $526,900.00, of which the State Participation Amount is $22,896.00 and Local Participation Amount is $504,004.00 for Professional Services and Engineering to Widen Las Vegas Trail from Two-Lanes to Four-Lanes from Interstate Highway 820 to Approximately Quebec Drive, to Include Intersection, Traffic Signal, Sidewalk, and Stormwater Crossing Improvement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The City Manager is hereby authorized to execute an Advance Funding Agreement with the Texas Department of Transportation (CSJ: 0902-90-176) in the Amount of $526,900.00, of which the Local Participation Amount is $504,004.00, not including cost overruns, for Professional Services and Engineering to Widen Las Vegas Trail from Two- Lanes to Four-Lanes from Interstate Highway 820 to Approximately Quebec Drive, to Include Intersection, Traffic Signal, Sidewalk, and Stormwater Crossing Improvement. Adopt the attached Resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation in the amount of$526,900.00,of which the State participation amount is$22,896.00 and the local participation amount is$504,004.00 for professional services and engineering to redesign North Las Vegas Trail from Loop 820 West to Quebec Drive(City Project No. 103085); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the 2007 CritCapProj-CO2013A Funds in the amount of$600,000.00,from available funds,for the purpose of funding the North Las Vegas Trail project(City Project No. 103085); 3. Authorize payment to the Texas Department of Transportation in the amount of 504,004.00;and 4. Amend the Fiscal Year 2022-2026 Capital Improvement Program. DISCUSSION: In 2019,the North Central Texas Council of Governments,Texas Department of Transportation and Cities of Fort Worth and White Settlement met to discuss potential improvements to redesign North Las Vegas Trail from Loop 820 West to Quebec Drive,to include sidewalks,intersection and traffic signal improvements.In addition,stormwater crossing improvements to address water overtopping at North Las Vegas Trail between Heron Drive and Shoreview Drive were identified. The Texas Department of Transportation(TXDOT)will manage and implement the project,which is within the Cities of Fort Worth and White Settlement.The portion of the project within the city limits of Fort Worth,will be a City of Fort Worth asset.The Texas Department of Transportation executed two separate preliminary engineering and environmental services agreements;one with the City of Fort Worth,and one with the City of White Settlement.The agreement with City of Fort Worth was approved on December 1,2020(M&C 20-0875)in an amount of$315,000.00. This M&C will provide funding to TXDOT to complete the final design and environmental services for the project. Upon completion of final engineering,a more accurate costs estimate for right-of-way,utilities,and construction will be identified.An amendment to the funding agreement between Texas Department of Transportation and the City of Fort Worth will be necessary to include the project phases of right-of-way,utilities, and construction. The action in this M&C will amend the FY2022-2026 Capital Improvement Program as approved in connection with Ordinance 25073- 09-2021. Funding is available for appropriation from available funds within the 2007 CritCapProj-CO2013A Fund for the purpose of funding the North Las Vegas Trail project. The North Las Vegas Trail project is located with COUNCIL DISTRICT 7. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education: TXDOT ,FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified-All Funds within the 2007 CritCapProj-CO2013A Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the 2007 CritCapProj-CO2013A Fund for the North Las Vegas Trail project to support the approval of the above recommendations and execution of the advance funding agreement. Prior to an expenditure being incurred,the Transportation&Public Works Department has the responsibility of verifying the availability of funds.
