Ordinance Na. 17141-09-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS 1N THE GRANTS FUND IN THE AMOUNT OF $539,735 FROM AVAILABLE FUNDS FOR THE PURPOSE OF UNDfNG TH!* SELECTIVE TRAFFIC ENFORCEMENT PROGRAM IN THE POLICE DEPARTMENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING TH[S ORDINANCE CUMULATIVE OF PR10R ORDINANCES IN CONFLfCT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED 13Y THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addikion to those amounts allocated to the various City departments for Fiscal Year 20D6- 2007 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $539,736 from available fiends for the purpose of funding the Selective Traffic Enforcement Program in the Police bepartment. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ardinance shall be incorporated into the ordinance of the municipal government of the City of Fort Worth far the ensuing Fiscal Year beginning October 1, 2006, and ending September 30, 2007, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ardinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed, SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to apply for and accept, if awarded, a Comprehensive STEP grant in the amount of $416,280 and a Commercial Motor Vehicle STEP grant in the amount of $63,720 from the Texas Department of Transportation; 2. Authorize the City Manager to enter into a contract with the Texas Department of Transportation for the Comprehensive STEP and Commercial Motor Vehicle STEP grant implementation during Fiscal Year 2007, contingent upon appropriation of matching funds; 3. Authorize the transfer of $52,293 from the State Awarded Assets Fund to the Grant Fund for the City's match, of the Comprehensive STEP grant, contingent upon receipt of adequate funding in the FY2007 State Awarded Assets fund; 4. Authorize the transfer of $7,443 from the Federal Awarded Assets Fund to the Grant Fund for the City's match of the Commercial Vehicle STEP grant, contingent upon receipt of adequate funding in the FY 2007 Federal Awarded Assets fund; and 5. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant f=und by $533,736 from available funds. ®[SCUSSI©N: Each year, the Texas Department of Transportation accepts proposals far projects aimed at reducing the number of motor vehicle crashes, injuries and fatalities. The Police Department submitted two proposals to implement increased enforcement of traffic safety-related laws and to increase public education about traffic safety issues. The Comprehensive STEP grant activities include speed enforcement, seatbelt enforcement, DWI enforcement and intersection traffic control enforcement. The Commercial Motor Vehicle grant includes enforcement specifically related to commercial motor vehicles. The Texas Department of Transportation has approved bath proposals and the City will be receiving $416,280 in Comprehensive STEP funds for 2007. This project requires matching funds in the amount of $52,293. The City will receive $63,720 in Commercial Motor Vehicle STEP funds with a required $7,443 in matching funds.
