HomeMy WebLinkAboutContract 56059-A1 CSC No. 56059-A1 AMENDMENT No . 1 TO CITY SECRETARY CONTRACT No. 56059 WHEREAS, the City of Fort Worth (CITY) and Carollo Engineers, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 56059, (the CONTRACT) which was authorized by M&C 21- 0374 on the 8"h day of June, 2021 in the amount of $155,200 .00; and WHEREAS, the CONTRACT involves engineering services for the following project: Rolling Hills (RH) Water Treatment Plant Chlorine Scrubber Systems; WHEREAS , it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $450, 000. 00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $605,.200, 00. 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. PROJECT SUMMARY The Rolling Hills Water Treatment Plant (RHWTP) uses gaseous chlorine for disinfection. The plant has two 25-tan stationary bulk chlorine storage tanks and two unloading points for 90-ton bulk chlorine tank rail cars, The plant has an existing emergency chlorine scrubber system designed to contain and treat the accidental release of chlorine gas from the largest (90-ton) bulk chlorine storage tank. ENGINEER completed a condition assessment of the existing chlorine scrubber system at the Rolling Hills Water Treatment Plant.The condition assessment recommended replacement of the existing 90-Ton emergency chlorine scrubber system. Several alternatives were evaluated and presented to the CITY, The CITY chose replacement of the scrubber with a similar configuration: one scrubber and one tank system capable of handling the accidental release from (90 ton) bulk chlorine storage tank. FINAL DESIGN. Plans and Specifications will be prepared for one bid package for the improvements identified in the Project Elements. The final design will be submitted to the CITY at the 50% and 90% completion levels for OWNER review and comments and at 100% for bid advertisement. All submittals will include electronic version in portable document format(.pcl ). Work will comply with applicable local, state, and federal regulations in effect at the time Final Design begins: 2.1. Fifty Percent Submittal ENGINEER will incorporate the FWWD review comments and ENGINEER's internal review comments and finalize the Preliminary Design Report. In addition, the plans and specifications will be completed to the 50% level under this task. Four (4) copies of the plans (11x17 format) and specifications will be submitted for review and comment along with an updated opinion of probable construction cost. 2.2. Fifty Percent Design Review Workshop A 50% Design Review Workshop will be conducted two to three weeks after the delivery of the 50% Plans and Specifications. FWWD comments to the plans, specifications, and opinion of probable construction costs will be received and discussed in a workshop format. ENGINEER will present a summary of the project status, outstanding issues, changes, decisions required, and schedule. 2.3. Ninety Percent Submittal ENGINEER will incorporate the FWWD review comments and ENGINEER's internal review. The plans and specifications will be completed to the 90% level under this task. Four (4) copies of the plans (11x17 format) and specifications will be submitted for review and comment along with an updated opinion of probable construction cost. 2.4. Ninety Percent Design Review Workshop The 90% Design Review Workshop will be conducted two to three weeks after the delivery of the 90% Plans and Specifications. FWWD comments to the plans, specifications, and opinion of probable construction costs will be received and discussed in a workshop format. ENGINEER will present a summary of the project status, outstanding issues, changes, decisions required, and schedule. 2.5. 1DO% (Bid Ready) Documents ENGINEER will incorporate FWWD review comments and ENGINEER's internal quality review comments to produce sealed and signed plans and specifications (Bid Ready Contract Documents). Five (5) copies of the plans (11x17 format) and specifications will be submitted. 2.6. Cost Estimates The ENGINEER will prepare an opinion of probable construction cost that will be updated at the 50%, 90%, and 1DO% documents. Cost estimate will be prepared in the ENGINEER'S standard cost estimating format. Quality Management ENGINEER will manage the quality of the deliverables throughout the development of the project including the 50% submittal, 90% Submittal and Bid Read Document, Specific activities the ENGNEER will employ include: 1. Internal peer review of concepts by senior staff not directly involved with the Project during the Preliminary Design Phase. 2. Quality check of deliverables performed by a team of qualified senior staff for each deliverable including 3. Constructability review of the 90% deliverable 2.8. Coordination with Fort Worth Fire Department(FWFD) This task includes coordination with the fire department for review and approval of the improvements. A total of one (1) face to face meeting with the FWWD is assumed for this task, 2.9. TCEQ Coordination This task includes preparation of summary transmittal letters to TCEQ to comply with TCEQ Chapter 290 requirements. Bid Support 0 The ENGINEER shall upload all plans and contract documents onto Buzzsaw for access to potential bidders. o Plan Sets are to be uploaded to BIM360 in .pdf formats, .pdf. The .pdf will consist of one file of the entire plan set. • The ENGINEER will develop and implement procedures for receiving and answering bidders' questions and requests for additional information. The procedures shall include a log of all significant bidders' questions and requests and the response thereto. The log shall be housed and maintained in the project's BIM 360 (or other applicable City provided software) folder titled Request for Information. The ENGINEER will provide technical interpretation of the contract bid documents and will prepare proposed responses to all bidder's questions and requests, in the form of addenda. The ENGINEER shall upload all approved addenda onto Buzzsaw and mail addenda to all plan holders. • Attend the pre-bid conference in support of the CITY. + Assist the CITY in determining the qualifications and acceptability of prospective contractors, subcontractors, and suppliers. * Attend the bid opening in support of the CITY. Tabulate and review all bids received for the construction project, assist the CITY in evaluating bids, and recommend award of the contract. A copy of the Bid Tabulation and the CFW Data Spreadsheet created utilizing CFW Bid tools only are to be uploaded into the project's Bid Results folder on BIM360. • Incorporate all addenda into the contract documents and issue conformed sets. 3.2. Conformed Documents At the completion of the bid period, ENGINEER will prepare conformed drawings and specifications consisting of the bid documents updated to reflect the administrative and technical addenda and the executed contract documents. ASSUMPTIONS The project will be bid only once and awarded to one contractor. • 4 sets of size drawings plans and 4 sets specifications (conformed, if applicable) will be delivered to the CITY. • PDF, DWF and DWG files will be uploaded to Buzzsaw. However, ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER because of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. These additional services include but are not limited to the following: • Design of caustic containment volume in addition to the existing containment area. • Modification to duct work or piping inside the existing chlorine storage building or outside of the immediate scrubber area. • Services related to development of the CITY's project financing and/or budget. • Services related to disputes over pre-qualification, bid protests, bid rejection and re- bidding of the contract for construction. DISCUSSION: On June 8, 2021, Mayor and Council Communication (M&C) 21-0374, authorized an engineering agreement with Carollo Engineers, Inc. (City Secretary Contract No. 56059), in the amount of $155,200.00, for an evaluation and to determine whether to replace or upgrade the existing chlorine scrubber system. The proposed Amendment will provide plans, specifications, and contract documents for the replacement of existing chlorine scrubber system. Carollo Engineers, Inc., proposes to perform the additional services not to exceed fee of$450,000.00. Staff considers the fee to be fair and reasonable for the scope of services proposed. In addition to the amendment amount, $80,000.00 is required for project management and material testing. This project will have no impact on the Water Department operating budget when complete. It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan throughout the fiscal year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. This project is anticipated to be included in a future revenue bond issue for the Water& Sewer Fund. Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation authority authorized under the Callable Commercial Paper Program (CP)will be used to provide interim financing for this project until debt is issued. Once debt associated with this project is sold, bond proceeds will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the attached Reimbursement Resolution. Under federal law, debt must be issued within approximately three years in order for these expenses to be reimbursable. Adoption of the attached resolution does not obligate the City to sell bonds, but preserves the ability to reimburse itself from tax- exempt bond proceeds. Business Equity: Carollo Engineers, Inc. agrees to maintain its initial M/WBE commitment of seven percent that it made on the original agreement and extend and maintain that same M/WBE commitment of seven percent to this first amendment. Therefore Carollo Engineers, Inc. remains in compliance with the City's Business Equity Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICT 8 and serves all COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that funds are currently available in the UCMLPR W&S Commercial Paper project within the W&S Commercial Paper Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Commercial Paper Fund for the RH Chlorine Scrubber System project to support the approval of the above recommendations and execution of the contract. Prior to any expenditure being incurred, the Water Department has the responsibility to validate the availability of funds.
