HomeMy WebLinkAboutOrdinance 25805-10-2022 ORDINANCE NO.25805-10-2022 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE FORT WORTH PUBLIC ART- POLYTECHNIC URBAN VILLA PROJECT (CITY PROJECT NO. 104294) IN THE AMOUNT OF $73,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE EAST ROSEDALE STREET US 287 T PROJECT (CITY PROJECT NO. C00142) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be adjusted estimated receipts and appropriations in the Specially Funded Projects Fund by increasing estimated receipts and appropriations in the Fort Worth Public Art- Polytechnic Urban Villa project (City Project No. 104294) in the amount of $73,000.00 and decreasing estimated receipts and appropriations in the East Rosedale Street US 287 T project(City Project No.C00142) by the same amount. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Specially Funded Projects Fund by increasing estimated receipts and appropriations in the Fort Worth Public Art-Polytechnic Urban Villa project(City Project No. 104294)in the amount of$73,000.00,and decreasing estimated receipts and appropriations in the East Rosedale Street US 287 T project(City Project No.C00142)by the same amount;and 2. Amend the Fiscal Years 2022-2026 Capital Improvement Program. DISCUSSION: The purpose of this M&C is to authorize separation of the Polytechnic Urban Village public art project from a capital construction project in the City's Financial System to facilitate project close-out. The Polytechnic Urban Village public art project is managed by the Arts Council of Fort Worth (ACFW)as part of the Fort Worth Public Art(FWPA) Program. This project is currently embedded in an associated capital construction project in the City's financial system. In 2001,City Council adopted an ordinance that established the Fort Worth Public Art Program and set forth that 2%of bond proceeds would be set aside for public art projects associated with capital construction projects included in the same bond program and proposition.Within the City's financial system, FWPA was given its own activity code that was embedded into the related capital construction project. The identified capital construction project with active public art project to be separated is East Rosedale Street(US 287 to Miller). Since the associated capital construction project is complete,staff would like to separate the active public art project by moving existing receipts,appropriations and expenditures to a separate FWPA Polytechnic Urban Village project number.This will allow departments with completed capital construction projects to fully balance and close the projects,while ACFW works to complete the associated public art project.The staff at ACFW ensures that the bond spending requirements will continue to be met. Starting with the 2014 Bond Program,staff has adopted the practice of creating separate project numbers for each of the public art projects within bond programs. Funding for the Fort Worth Public Art-Polytechnic Urban Villa project was not included in the FY2022-2026 Capital Improvement Program. Funding in the amount of$73,000.00 is needed to move to the Fort Worth Public Art-Polytechnic Urban Villa project from the East Rosedale Street US 287 T project in order to facilitate project closure.This action in this M&C will amend the Fiscal Years 2022-2026 Capital improvement Program as approved in connection with Ordinance 25073-09-2021. The listed capital construction projects are located in COUNCIL DISTRICT 8. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the East Rosedale Street[US 287 T project within the Specially Funded Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the Specially Funded Projects Fund for the FWPA-Polytechnic Urban Villa project.
