HomeMy WebLinkAboutOrdinance 740- #01 6 ORDINANCE NO- AN ORDINANCE GRANTING THE FORT WORTH BELT RAILWAT 0,01WARY, ITS SUCCESSORS AND ASSIGNS, THE RIGHT ANDFRANCHISH TO EXTEND ITS RAIIIVAY TRACKS AND 14AINTAIN AND CONSTRUCT SAME OVER CERTAIN STREETS IN THE CITY OF FORT WORTH, TEXAS. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH: 1. That the right, privilege and franchise is hereby given and granted to the Fort Worth Belt Railway Company, a Corporation, its successors and assigns, for a period of 25 years, to construct, maintain and operate an extension of its present line of rai3way, beginning at the terminus of its present line of railway on 21 at Street at the West line of North Commerce Streiwt; thence West along 21st Street to a point 20 feet east of the East line of N. Main Street; also beginning at the intersection of the N. line of 21st Street with the alley through the center of Block 175 of the M. G. Ellis, Addition to the City of North Fort W-orth-1,--thanas in said alley to a point 350 feet North of the North line of 21 at Street, a total distance of leas than one mile, being more par- ticularly shown by a drawing of said line of railway tracks hereto attached and made a part of this ordinance, with the right, priv- ilege and franchise to maintain and operate said line of railway for the purpose of operating steam cars and trains thereon and thereover as an extension of said Belt line or switch line of rail- way tracks. 2* This franchise is granted upon the condition that the grantee, its successors and assigns, will lay and construct said over which it passes as fixed and established by the City of Fort Wcrth, and that it will construct said tracks of first- class rusterial and keep and maintain the same in like manner and restore the streets after the construction of same to such a condition as Nvill not impeda or interfere with public travel. 3. The Fort I(Vorth Belt RaAl,&ay Company, its and assigns, shall be bound to pa%re said streets above mentioned from time to time, or so mueb of,' same &uj is occupied by its tracks, and for 18-feet on each amide thereof, with such material and like material as that viAdth 'which the streets may be pared. 4. The Fort Worth Belt Railway Company, its succes�,,,' Ors and assigns, furthermore agree to indemnify, am d, hold the City of Fort Worth harmless against all coo-to, injuries or damages wtich may be occasioned as as result of the construction, main- tenance and operation of its said lines on said streets. That the said Fort Worth Belt Railway Company, shall File its acceptance of this franchise witbin 30 day's from the passage hereof. 6. That this ordinance shall take effect and be in force from the day of its passage.
