DATE: 06/28/22 M&C FILE NUMBER: M&C 22-0525
LOG NAME: 20SWM 7TH ST AT BURNETT SDR CONSTRUCTION
SUBJECT
(CD 9)Authorize Execution of a Construction Contract with PM Construction & Rehab, LLC, LJG
ioo Seuth Gentral in the Amount of$524,800.00 for 7th Street at Burnett Storm Drain
Rehabilitation Project
RECOMMENDATION:
It is recommended that the City Council authorize the execution of a contract with PM Construction
& Rehab, LLC, 1PR Se,•t" GentFal in the amount of$524,800.00 for 7th Street at Burnett Storm
Drain Rehabilitation project.
DISCUSSION:
Approval of this Mayor and Council Communication (M&C)will authorize the execution of a
construction contract for the rehabilitation of storm drain pipe in 7th Street from Lexington Street to
Cherry Street and 6th Street from Cherry Street to Burnett Street. The project is a part of the
Stormwater Program's Storm Drain Rehabilitation Program which assesses the condition of
existing drainage pipe systems to identify and prioritize pipes for rehabilitation before potential
collapse and/or sinkholes form.
The storm drain pipe rehabilitation will be done primarily through trenchless methods that avoid
cutting into the street. At the intersection of 6th Street and Burnett Street, some excavation will be
required to repair a storm drain pipe and increase the existing inlet size.
The project was advertised for bid in the Fort Worth Star-Telegram on April 7, 2022 and April 14,
2022. On May 5, 2022, the following bids were received:
Bidder ] Amount
FConstruction & Rehab $524,800.00
[nsituform $562,178.00
Construction is expected to start in September 2022 and be completed by November 2022.
In addition to the contract amount, $81,000.00 is required for project management, material testing
and inspection and $26,000.00 is provided for project contingencies. The project is funded by
2020 Stormwater Utility Revenue Bonds.
DVIN OFFICE— PM Construction & Rehab, LLC is in compliance with the City's Business Equity
Ordinance by committing to 9% Business Equity participation and documenting good faith effort.
PM Construction & Rehab, LLC identified several subcontracting and supplier opportunities.
However, the firms contacted in the areas identified did not respond or did not submit the lowest
bids. The City's Business Equity goal on this project is 13%.
This project is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously
appropriated, in the Stormwater Rev Bonds 2020 Fund for the 7th St at Burnett SDR project. Prior
to any expenditure being incurred, the Transportation & Public Works Department is responsible
for verifying the availability of funds.

VENDOR COMPLIANCE TO STATE LAW
SECTION 00 43 37
VENDOR COMPLIANCE TO STATE LAW NON RESIDENT BIDDER
Texas Government Code Chapter 2252 was adopted for the award of contracts to nonresident bidders. This law
provides that, in order to be awarded a contract as low bidder, nonresident bidders (out-of-state contractors
whose corporate offices or principal place of business are outside the State of Texas) bid projects for construction,
improvements, supplies or services in Texas at an amount lower than the lowest Texas resident bidder by the
same amount that a Texas resident bidder would be required to underbid a nonresident bidder in order to obtain a
comparable contract in the State which the nonresident's principal place of business is located.
The appropriate blanks in Section A must be filled out by all nonresident bidders in order for your bid to meet
specifications. The failure of nonresident bidders to do so will automatically disqualify that bidder. Resident bidders
must check the box in Section B.
A. Nonresident bidders in the State of our principal place of business,
are required to be percent lower than resident bidders by State Law. A copy of the
statute is attached.
Nonresident bidders in the State of our principal place of business,
are not required to underbid resident bidders.
B. The principal place of business of our company or our parent company or majority owner is
in the State of Texas.
