HomeMy WebLinkAboutResolution 5646-11-2022 A Resolution NO. 5646-11-2022 A RESOLUTION ESTABLISHING A PAY RATE ADJUSTMENT FOR HEARING OFFICER MARK WEIBEL; PROVIDING THAT THIS RESOLUTION SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, Chapter 7 of the Code of the City of Fort Worth (2015), as Amended, (City Code) provides for a hearing officer to hear appeals from decisions of the Director of Code Compliance regarding the probationary status, suspension or revocation of the registration of multi-family complexes; WHEREAS, Chapter 10 of the City Code provides for the appointment of one or more hearing officers who serve two-year terms and adjudicate cases involving parking, stopping, or standing of vehicles and conduct boot hearings; WHEREAS, Chapter 12.5 of the City Code provides for a hearing officer to hear formal appeals regarding solid waste and recycling decisions; WHEREAS, Chapter 22 of the City Code provides that the hearing officer oversees the Parking Violations Bureau and has original jurisdiction over cases involving violation of City ordinances governing the parking, stopping, or standing of vehicles and that the hearing officer conducts hearings involving violation of City ordinances governing abandoned and junked vehicles; and WHEREAS, M&C: 19-0365 and CSC — No. 53431 provides for a hearing officer to conduct hearings for the denial, suspension, and revocation of County permits within City limits, as set forth in Section 2.2 through 2.5 of the Tarrant County Game Room Regulations; WHEREAS, it is recommended that the City Council approve Hearing Officer Mark Weibel's pay rate adjustment of 4% for Fiscal Year 2023, with the new pay rate of$32.75 effective October 1, 2022. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: That the City Council hereby approve Hearing Officer Mark Weibel's pay rate adjustment of 4% for Fiscal Year 2023, with the new pay rate of $32.75 effective October 1, 2022. DISCUSSION: Section 10-7 of the Code of the City of Fort Worth (2015), as amended, (City Code)specifies that the City of Fort Worth Parking Violations Bureau is composed of one or more Hearing Officers who are appointed by the City Council for terms of two years and who report to and are under the administrative oversight of the Director of Municipal Court Services. Under Chapters 7, 10, 12.5,20 and 22 of the City Code,the City Council and the City Manager are tasked with appointing Hearing Officers to perform various functions and the parking violations Hearing Officer has been designated to perform those duties as well. The attached resolution would provide for the 4%pay rate increase to become effective on October 1,2022. The new pay rate adjustment will set the Fiscal Year(FY)2023 hourly pay rate for the Hearing Officer as follows: Increase from$31.49 to$32.75 per hour for Fiscal Year 2023 for Hearing Officer Mark Weibel. Funding is budgeted in the Regular Employee Salaries Account of the Municipal Court Administration Department's General Fund. The available balance for FY2023 is$1,120,519.00. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon the approval of the recommendation,funds are available in the current operating budget,as previously appropriated,in the General Fund.
