AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER AND SEWER BOND 2020A FUND BY
INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
SANITARY SEWER MAIN 257 PART 2 UPPER AND MIDDLE PROJECT (CITY
PROJECT NO. C01227) IN THE AMOUNT OF $130,610.00 AND DECREASING
ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED
PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the
Budget of the City Manager,there shall also be adjusted estimated receipts and appropriations in the Water
and Sewer Bond 2020A Fund by increasing estimated receipts and appropriations in the Sanitary Sewer Main
257 Part 2 Upper and Middle project(City Project No.CO1227)in the amount of$130,610.00 and decreasing
estimated receipts and appropriations in the Unspecified project (City Project No. UNSPEC) by the same
amount.
SECTION 2.
That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void
for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair
the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Change Order No.2 in the amount of$130,610.00 to City Secretary Contract No.52292 with Thalle Construction Co.,
Inc.,for the Sanitary Sewer Main 257 Part 2 Upper and Middle project for a revised contract cost of$11,193,452.24;and
2. Adopt the attached appropriation ordinance adjusting appropriations in the Water&Sewer Bond 2020A by increasing receipts and
appropriations in the Sanitary Sewer Main 257 Part 2 Upper and Middle project(City Project No.C01227)in the amount of$130,610.00
and decreasing receipts and appropriations in the UNSPECIFIED-ALL FUNDS project(City Project No. UNSPEC)by the same amount to
effect a portion of Water's contribution to the Fiscal Years 2023-2027 Capital Improvement Program.
DISCUSSION:
On April 16,2019, Mayor and Council Communication (M&C)C-29096, authorized a contract with Thalle Construction Co., Inc. in the amount of
$11,073,509.70(City Secretary Contract No.52292)for the Sanitary Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main, Part
2A project. The contract was subsequently revised by Change Order No. 1 with a net deduction of$10,667.46 administratively authorized on
September 4,2022,that provided for the installation of a siphon structure at Deer Creek without gabion baskets in order to avoid damage to the
encased pipe and composite manhole frame and cover.
Change Order No.2 provides compensation for the installation of a 94 foot segment of the project sewer main in order to avoid the destruction of
several large trees that are in direct conflict.
It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of within the annual budget ordinance, as
projects commence, additional funding needs are identified, and to comply with bond covenants.The actions in the M&C will appropriate funds in
support of Water's portion of the City of Fort Worth's Fiscal Years 2023-2027 Capital Improvement Program,as follows:

Funding is currently available in the Unspecified-All Funds project within the Water&Sewer Bond 2020A Fund for the purpose of funding the
Sanitary Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main, Part 2 project.

DVIN:A waiver of the goal for Business Equity subcontracting requirements was requested,and approved by the DVIN,in accordance with the
applicable Ordinance, because the purchase of goods or services is from sources where subcontracting or supplier opportunities are negligible.
The project is located in COUNCIL DISTRICTS 8.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Unspecified-All Funds project within the Water&Sewer Bond 2020A Fund
and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the Water&
Sewer Bond 2020A Fund for the SS Main 257 Part 2 Upper and M project to support the approval of the above recommendations and execution
of the change order. Prior to any expenditure being incurred,the Water Department has the responsibility of verifying the availability of funds.
