AN ORDINANCE VACATING, ABANDONING AND EXTINGUISHING
PORTIONS OF MALVEY AVENUE, LITTLEPAGE STREET, AND PART OFA
16-FOOT WIDE ALLEY, SITUATED IN THE JOSEPH TURNER SURVEY,
ABSTRACT NO. 1500, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS;
IN THE CHAMBERLIN ARLINGTON AND CHAMBERLIN ARLINGTON
HEIGHTS ADDITIONS, ADDITIONS TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS RECORDED IN VOLUME 63, PAGE 71 AND
VOLUME 63, PAGE 21, PLAT RECOREDS, TARRANT COUNTY, TEXAS, AND
CONTAINING APPROXIMATELY 124,164 SQUARE FEET OR 2.8504 ACRES
OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That portions of Malvey Avenue (an 80-foot right-of-way), Littlepage Street(a 60
foot right-of-way) portions of a 16-foot right-of-way situated in the Joseph Turner
Survey, Abstract No. 1500, City of Fort Worth, Tarrant County, Texas, in the Chamberlin
Arlington and Chamberlin Arlington Heights Additions, additions to the City of Fort
Worth, Tarrant County, Texas, as recorded in Volume 63, Page 71 and Volume 63, Page
21, Plat Records, Tarrant County, Texas, and containing approximately 124,164 square
feet or 2.8504 acres of land, and as more specifically described in Exhibits "A", attached
hereto and incorporated herein by reference, be and the same is vacated, abandoned and
extinguished.
SECTION 2.
That the easements to the land in the above-described vacated public rights of
way are hereby released and shall revert to the adjacent owner as provided by law.

SECTION 3.
That all existing utility easements shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a 2.8504 acres (124,164 square foot)tract of land situated in the Joseph Turner Survey, Abstract No. 1500,
City of Fort Worth, Tarrant County, Texas; said tract being part of Malvey Avenue (an 80-foot wide right-of-way),
part of Littlepage Street (a 60-foot wide right-of-way) and part of a 16-foot wide alley, dedicated by the plat of
Chamberlin Arlington Addition, an addition to the City of Fort Worth according to the plat recorded in Volume 63,
Page 71 of the Plat Records of Tarrant County, Texas; and dedicated by the plat of Chamberlin Arlington Heights,
1st Filing, an addition to the City of Fort Worth according to the plat recorded in Volume 63, Page 21 of said Plat
Records; said tract being more particularly described as follows:
BEGINNING at a point at the intersection of the north line of said Malvey Avenue and the west right-of-way line of
Halloran Street(a 60-foot wide right-of-way);
THENCE South 00e05'46" West, along the said west line of Halloran Street, a distance of 80.00 feet to a point for
corner;
THENCE North 89°57'50" West, along the south line of said Malvey Avenue, a distance of 500.00 feet to a 1/2-inch
iron rod found for corner in the east line of said Littlepage Street;
THENCE South 00005'46"West, along the said east line of Littlepage Street, a distance of 125.00 feet to a point for
corner;
THENCE North 89°57'50" West, departing the said east line of Littlepage Street, a distance of 60.00 feet to a

Heights Addition to Be Replatted with the Adjoining Property for a Multifamily Development
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a portion of Malvey Avenue, Littlepage Street and alleys in Blocks 1 and 2,Chamberlin Arlington
Heights Addition to be replatted with the adjoining property for a multifamily development;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Kimley-Horn,on behalf of L H Meeker Land, LLC, has requested vacation of these rights-of-way to be replatted with the adjoining property for a
multifamily development.The City Plan Commission recommended approval of this request at its meetings on October 27,2021 and February 9,
2022.An acceptable final plat(FP-22-123)has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007, Mayor and
Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the streets and alleys.
This project is located in COUNCIL DISTRICT 3.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
