SECTION I
THAT MRp; $ the City Council of said City bas by
rolso tion, ordered the improvement of Warner Road from the ixi-
south line of Glenco Terrace to the inter-
,,, eetion of the north line of Iffindsor Place and Glenoo Terrace
f'roi' h „ l to eeetioa of the east line of Forest Park Soule-
a` to the west line of 'darner :Road and Wilshire Rou.levard from
the inf', eotion of the east line of 'Forest lark Boulevard, to
the west line of Rimer Road. and Hawthorne Avenue From the inter-
section with the east line of Forest Park Boulevard to the west
line of Darner Read and Huntington Drive from the intersection of
the east line of Forest Bark Boulevard to the west line of
'garner Road and Windsor Place from the intersection of the
east line of Forest Bark boulevards in said City by lighting
same with electric lights on ornamental concrete standards,'
and
MPIREAS1 an estimate of said work and specifications
therefore Yea*e been filed with the City Council by the City En-
gineer and approved by the Qouacil; and
MR OW, after notice as required by the general lams
of the Mate of 'Texas passed by the 38th Legislature, Chapter IX
and ordinances of the said City, full and fair hearing has been
granted to the owners of property abutting upon said proposed
improvement at which hearing all q gists to said assessments and
objections thereto, and the evidence with reference thersto has
been fully heard and considered by the Council, and the said Council
has determined and adjudged the several amounts which° should be
assessed against each owner of property and his or her property
and has determined and adjudged the er uiti es and rights of the
several owners of the property interested; and
VMAS, the said Council has fully and fairly considered
and adjudged the respective benefits acdruing to said several owners
and their property, by means of said improvements, and has° adjudged
that in eadh assessment hereinafter made against the several o ers
of property herein named and their property, the:benefits received
�y said respective pieces of lots of property and their owners will
e; red the respective amounts assessed against the same in each case.

That there shad be and is hereby expressly,, assessed
against each of the several owners hereinafter , mn ,'anal their
several lots or pieces of property ovneuby them
hereinafter described, abutting an said proposed improvement,,, the
several s=s hereinafter mentioned, and said several sums se;
assessed are hereby declared to be a personal, liability which .shall
be discharged and paid, with interest and penalties, as herein
provided, by said several owners, and a lien is hereby declared
and fixed upon each of several leas or pieces of ground to secure
the patent of the sum assessed against the sameith interest and
penalties which may be enforced against said premises and the owmrs
thereof as hereinafter provided the said seers and the lots or
pieces of groqna: owned by them respectively and the amp4nts of the
respective assessments hereby made, against each owner and his pro-
.perty are named., described and f .=ed as set forth in the attached
table.

'SECTION III,
That as said improvement is completed and in oper -
tion in front of each piece or parcel of ground, the City
Bh-
gineer shall inspect the same, and if he shall approve same,
he shall citify his said approval to the City Council, which
may accept or reject the same. TTpon the acceptance of such work
in front of any, piece or parcel of ground by thity Council
the amount assessed against the sane and the owner thereof as
herein provided shall at once become payable 'by said owner. Said
owner,may however, at his option,, pay one-fifth of said ass a -
ment when due in cash, ons-fift"O on or before one year, from the
date Whex the first installment becomes due, ore-f'afth on or
before t p years from said date) one-fifth on or before three
years from said elate and one-fifty, on or before tour years from
said date, with interest on deferred payments from said date
until paid at the rate of 7 per annum, with the usual provision
for attorney"s fees in the event of d.af'a.ut. and provision that
if default shall be made in the payment of any installment when
due, then the whole of said` instalhments shall at once become
due and collectable.
MOTION ITT.
That if the amount assessed, against any particular
piece of land herein described and its owner,shall not be paid
zth days aterecomix g due, as specified in the preced-
ing section;., there shall be added to said sum a penalty of ten
per cent (14K) of the amount thereof, which shall be secured and
collected in thee, same manner as said assassment.

That when said improvement shall be completed and in
operation in front of any parcel of land herein mentioned, and
hall be approved by the City Ragineer and said ouncil as herein
provi,U4, if' the amount assessed against said parcel and the
owner thereof shall not be paid immediately, the City Engineer
shall at bnoe make out and file with the City Clerk for the use
of the Mayor a statement of the expense of the work aharga,4 to

, owner, and his property, the amount assessed against said
ovner and a fair description of his property, which description
may be by lot, block or plat number, or by reference to the re-
cords, or in other manner which will sufficiently identify the
same. The said statement shall also state the date when the said
amount assessed became due, and the amount of penalties thereon,
and date when said penalties will accrue, and shall state that
interest is payable upon the amotmt assessed at the rate of 7%
per anam from the date of said statement, and that the amounts
evidenced by said statement are payable and secured by lien on
s4i',d premivep duly fixed by the City. Said statement or certi-
ficate shall also recite that all legal prereqdsites and all
things necessary to the validity and enforcibility of said as-
sessment and lien upon the said parcel of land, and of the person-
at'L liability declared against the owner thereof, have been done
and perform e&I""'in, accordancel,with the general laws of the State of
Texas as passed by the 38th Legislature, Chapter IX and the Or-
di=—Ges of the City, which recital shall be prima facie evidence
of the truth of the facts so recited, and shall without further
evidence be in all courts taken and accepted as true.
The said statement so prepared by the City Engineer
shall be signed by him and filed with the City Clerk for the use
of the Mayor,,,,
