TTpon the acceptance of such work in front of any, piece or parcel of ground by thity Council the amount assessed against the sane and the owner thereof as herein provided shall at once become payable 'by said owner. Said owner,may however, at his option,, pay one-fifth of said ass a - ment when due in cash, ons-fift"O on or before one year, from the date Whex the first installment becomes due, ore-f'afth on or before t p years from said date) one-fifth on or before three years from said elate and one-fifty, on or before tour years from said date, with interest on deferred payments from said date until paid at the rate of 7 per annum, with the usual provision for attorney"s fees in the event of d.af'a.ut. and provision that if default shall be made in the payment of any installment when due, then the whole of said` instalhments shall at once become due and collectable. MOTION ITT. That if the amount assessed, against any particular piece of land herein described and its owner,shall not be paid zth days aterecomix g due, as specified in the preced- ing section;., there shall be added to said sum a penalty of ten per cent (14K) of the amount thereof, which shall be secured and collected in thee, same manner as said assassment. IM That when said improvement shall be completed and in operation in front of any parcel of land herein mentioned, and hall be approved by the City Ragineer and said ouncil as herein provi,U4, if' the amount assessed against said parcel and the owner thereof shall not be paid immediately, the City Engineer shall at bnoe make out and file with the City Clerk for the use of the Mayor a statement of the expense of the work aharga,4 to su64 51 , owner, and his property, the amount assessed against said ovner and a fair description of his property, which description may be by lot, block or plat number, or by reference to the re- cords, or in other manner which will sufficiently identify the same. The said statement shall also state the date when the said amount assessed became due, and the amount of penalties thereon, and date when said penalties will accrue, and shall state that interest is payable upon the amotmt assessed at the rate of 7% per anam from the date of said statement, and that the amounts evidenced by said statement are payable and secured by lien on s4i',d premivep duly fixed by the City. Said statement or certi- ficate shall also recite that all legal prereqdsites and all things necessary to the validity and enforcibility of said as- sessment and lien upon the said parcel of land, and of the person- at'L liability declared against the owner thereof, have been done and perform e&I""'in, accordancel,with the general laws of the State of Texas as passed by the 38th Legislature, Chapter IX and the Or- di=—Ges of the City, which recital shall be prima facie evidence of the truth of the facts so recited, and shall without further evidence be in all courts taken and accepted as true.
