HomeMy WebLinkAboutResolution 5652-11-2022 A Resolution NO. 5652-11-2022 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $608,371.00, WITH FEDERAL PARTICIPATION IN THE AMOUNT OF $395,445.00, STATE PARTICIPATION IN THE AMOUNT OF $25,907.00 AND LOCAL PARTICIPATION IN THE AMOUNT OF $187,019.00, FOR ENGINEERING, ENVIRONMENTAL SERVICES AND CONSTRUCTION OF MITCHELL BOULEVARD AT SOUTH BEACH STREET HIGHWAY SAFETY IMPROVEMENT PROJECT WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes, and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision, and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds, and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects, and WHEREAS, the Texas Transportation Commission passed Minute Order Number 115814 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as construct new roadway turn lanes, intersection safety lighting, pedestrian crossings and pavement markings; and WHEREAS, the City of Fort Worth identified the need to rebuild the intersection including signals,pedestrian crossings, American with Disabilities Act(ADA) ramps, intersection lighting, adding a right turn lane for northbound traffic, adding a left turn lane for southbound traffic, interconnect with another signalized intersection, constructing a larger westbound channelized right turn island, and refresh and modify pavement markings; and WHEREAS, the City of Fort Worth and Texas Department of Transportation have negotiated terms of an Advance Funding Agreement in the amount of $608,371.00, with federal participation in the amount of $395,445.00, state participation in the amount of $25,907.00 and local participation in the amount of $187,019.00.00, for engineering, environmental services and construction of Mitchell Boulevard at South Beach Street highway safety improvement project improvements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The City Manager is hereby authorized to execute an Advance Funding Agreement with the Texas Department of Transportation (CSJ: 0902-90-210) in the amount of $608,371.00, with federal participation in the amount of $395,445.00, state participation in the amount of $25,907.00 and local participation in the amount of $187,019.00, plus cost overruns, for engineering, environmental services and construction of Mitchell Boulevard at South Beach Street Highway Safety Improvement Project improvements. Adopt the attached Resolution authorizing execution of an advance funding agreement with the Texas Department of Transportation in the amount of$608,371.00 with federal participation in the amount of$395,445.00,State participation in the amount of$25,907.00 and local participation in the amount of$187,019.00 for the Mitchell Boulevard at South Beach Street Highway Safety Improvements-project(City Project No. 103633); 2. Adopt the attached appropriation ordinance adjusting appropriations in the 2018 Bond Program Fund in the amount of$187,019.00, by increasing appropriations in the Mitchell Boulevard at South Beach Street project(City Project No. 103633), and decreasing appropriations in the Authorized, Not Appropriated project(City Project No. U34018) by the same amount; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Other Fund, subject to receipt of the grant,in the amount up to$395,445.00 for the Mitchell Boulevard at South Beach Street project(City Project No. 103633); and 4. Amend the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing execution of an Advance Funding Agreement (AFA)with the Texas Department of Transportation(TxDOT)in the amount of$608,371.00,of which$187,019.00 is City of Fort Worth's(City) participation and authorize acceptance of federal grant funds and state funds in the amount of$395,445.00 for construction of the Mitchell Boulevard at South Beach Street project.(City Project No. 103633). The scope of this project includes signal rebuild including pedestrian crossings, construction of American with Disabilities Act(ADA)ramps, intersection lighting,adding_a right turn lane for northbound traffic,adding a left turn lane for southbound traffic, interconnecting with nearest signalized intersection,constructing a larger westbound channelized right turn island,and to-refresh and modify pavement at the intersection of Mitchell Boulevard at South Beach Street. This project will be led by TXDOT in June 2023.The State is responsible for all construction activities within the scope of this project.The State will be responsible for securing the federal and State share of the funding required for the development and construction of the project.City funds have been appropriated to this project for design, right-of-way, utilities and project management costs.The City bears the responsibility to pay for cost overruns.At the end of the project,the asset will remain with the City of Fort Worth. The table below summarizes funding for the project: Federal State Local Total 34018-2018 Bond Program Fund $187,019.00 $187,019.00 31003-General Capital Project Other- Federal Construction Funding F,$395,445.00� $395.445.00 Unappropriated State Costs �[�$25,907.00I $25,907.00i Total $395,445.00$25,907.00 $187,019.00 $608,371.00j This project is included in the 2018 Bond Program Fund.Available resources within the General Fund will be used to provide interim financing until debt is issued.Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No.23209-05-2018) and subsequent actions taken by the Mayor and Council. The additional construction funding for this project was not included in the Fiscal Year 2023-2027 Capital Improvement Program because the project was not identified for funding by TxDOT at the time the Capital Improvement Program plan was developed.The action in this M&C will amend the Fiscal Year 2023-2027 Capital Improvement Program as approved in connection with Ordinance 25773-09-2022. This project is located in COUNCIL DISTRICT 5 A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education: TXDOT&Federal FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the current capital budget,as appropriated, in the Grants Capital Projects Other Fund and 2018 Bond Program Fund. The Transportation and Public Works Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City.Prior to expenditures being incurred,the Transportation&Public Works Department has the responsibility to validate the availability of funds.This is reimbursement grant.
