COUNCIL OF THE CITY OF FORT WORTH, TEXAS CONSENTING TO THE DIVISION
OF TRADITION MUNICIPAL UTILITY DISTRICT NO.2A OF DENTON COUNTY
WHEREAS, Tradition Municipal Utility District No. 2 of Denton County (the "Original
District") was heretofore duly created pursuant to House Bill No. 3182, 80th Texas Legislature,
Regular Session (the "Creation Legislation"), codified as Chapter 8189, Texas Special District Local
Laws Code, effective September 1, 2007, as a conservation and reclamation district created under and
essential to accomplish the purposes of Section 52, Article III, and Section 59, Article XVI, of the
Texas Constitution and operating pursuant to Chapters 49 and 54 of the Texas Water Code; and
WHEREAS, pursuant to an election held on May 9, 2015, the Original District was divided
into Tradition Municipal Utility District No. 2A of Denton County (the 'District") and Tradition
Municipal Utility District No. 2B of Denton County;
WHEREAS, the Creation Legislation contemplates-that the Original District and any new
district created through division, including the District, will be divided to create multiple smaller
districts; and
WHEREAS, Section 8189.103(d)(2) of the Creation Legislation provides that, at the time a
new district is created by division of the District, the new district may not consist of fewer than 300
acres or more than 500 acres without obtaining prior consent from the City Council of the City of Fort
Worth, Texas (the "City");
WHEREAS, the District has requested that the City Council of the City consent to the
division of the District, in accordance with Section 8189.103(d)(2) of the Creation Legislation, into
Tradition Municipal Utility District No. 2C containing approximately 709.93 acres and Tradition
Municipal Utility District No. 2D containing approximately 549.96 acres, a copy of the map of said
division is attached hereto as Exhibit "A"; and
WHEREAS, on May 27, 2021, the City Council adopted Resolution No. 5392-05-2021
transferring certain extraterritorial jurisdiction to the City of Justin, including the area of land
comprised of the District provided however the District must still copy with its Creation Legislation;
WHEREAS, the City Council of the City desires to adopt a Resolution for the purpose of
consenting to the division of the District in accordance with the District's Creation Legislation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS, THAT:
1. That the above and foregoing premises are true and correct and are incorporated herein and
made a part hereof for all purposes.
2. That the City Council of the City of Fort Worth, Texas hereby grants its consent to and the
Mayor is instructed to execute such additional documents, if any, as required to evidence
the City of Fort Worth's consent, in accordance with Section 8189.103(d)(2) of the
Creation Legislation, to the division of the District into Tradition Municipal Utility
District No. 2C of Denton County containing approximately 709.93 acres and Tradition
Municipal Utility District No. 2D of Denton County containing approximately 549.96
acres.
3. That this resolution take effect immediately from and after its passage and is accordingly
so resolved.
