A RESOLUTION DETERMINING THE NECESSITY FOR ACQUIRING REAL
PROPERTY AND AUTHORIZING ITS APPROPRIATION OR
CONDEMNATION FOR PUBLIC USE
WHEREAS,the Fort Worth City Council on November 29,2022, in M&C 22-0998, ordered and
decreed that a public necessity existed to acquire 0.266 acres in permanent sewer easement and a total of
1.060 acres for temporary construction easements from improved property located south of the
intersection of the south Loop 820 and Kennedale Parkway in the Oak Crest Addition, Block 10, Lots 4-
6 and part of David Strickland Survey and Shelby County School Land Survey in Tarrant County, Texas,
as described in the exhibits attached to the above-referenced M&C;those exhibits are incorporated herein
for all purposes (the "Property");
WHEREAS,the Fort Worth City Council has determined that:
- the Property is needed for Lake Arlington Force Main and Lift Station Project(the "Project");
- the land rights in the Property are needed for new sewer improvements as necessary;
- public necessity required the acquisition by condemnation of the Property, located within the
alignment of the Project;
- the use of the Property will be a public use; and
- the Real Estate Division of the Property Management Department is authorized to acquire by
negotiation the Property needed for the Project.
WHEREAS, negotiations between the City of Fort Worth and the property owner, Jerry Coyel,
were unsuccessful due the inability to negotiate agreeable terms for the property interest being acquired
by the City of Fort Worth; and
WHEREAS, on this 29'h day of November, 2022, at a regular meeting of the Fort Worth City
Council, upon Motion of Councilmember Bivens, to wit:
"I move that the Fort Worth City Council adopt the resolution authorizing use of the power of
eminent domain to acquire a total of 0.266 acres in permanent sewer easements and a total of 1.060 acres
for temporary construction easements from improved property owned by Jerry Coyel. The property is
needed for the Lake Arlington Lift Station and Force Main project,a public use that will construct public
sewer improvements to increase the conveyance capacity necessary to handle projected growth within
the Village Creek Wastewater Basin. The property is located in the Oak Crest Addition, Block 10, Lots
4 - 6, in the David Strickland Survey and Shelby County School Land Survey in the City of Kennedale,
Tarrant County, Texas. The property interest to be acquired is described by metes and bounds and
depicted by survey exhibits attached to this Mayor and Council Communication."
Seconded by Councilmember Nettles,duly put and carried:RESOLUTION.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
The City of Fort Worth, Texas, is authorized to use the power of eminent domain to acquire the
Property for the public use and inclusion in the Project; and
The City Attorney be and is hereby authorized and directed to file or cause to be filed,to spend all
reasonable and necessary legal expenses, and to carry through to final judgment proceedings in eminent
domain for the acquisition of the property interest listed above and attached to the M&C.

LEGAL DESCRIPTION
PERMANENT 20' SEWER EASEMENT
Being a portion of Lot 6, Block 10 of Oak Crest Addition, an addition to the City of Fort Worth,
situated in Tarrant County, Texas as it appears upon the plat recorded in Volume 388-C, Page
81 of the Plat Records of Tarrant County, Texas (P.R.T.C.T.), and being more particularly
described as follows:
Commencing at a one inch iron pipe found at the beginning of a curve in the southeast line of
Lot 11, Block 9 Oak Crest Addition and in the north right of way line of Oak Crest Drive E. (a 50
feet wide right of way) from which a one inch iron pipe found for the east corner of Lot 5, Block 8
Oak Crest Addition, also being the intersection of the north right of way line of Oak Crest Drive
E. and the west right of way line of Lindale Road (a 50 feet wide right of way), bears S 45052'56"
W, a distance of 548.76 feet.
THENCE S 43041'05" E, a distance of 50 feet to the common line of Lot 3 in said Block 10 and
the south right of way line of Oak Crest Drive E. also being the beginning of a curve to the left
with a radius of 605.00', a chord bearing of N 31°24'41" E and a chord distance of 303.55 feet.
THENCE along said curve to the left through a central angle of 29003'30", an arc length of
306.83 feet to the south right of way line of Oak Crest Drive E. in the northwest line of lot 4 in
said Block 10.
THENCE N 16052'56" E, along the south right of way line of Oak Crest Drive E., a distance of
238.00 feet to the common north corner of Lot 5 in said Block 10 and said Lot 6.
THENCE S 44007'04" E, departing said south right of way line of Oak Crest Drive E., along the
common line of said Lot 5 and said Lot 6, a distance of 982.34 feet to a 5/8 iron rod set with
plastic cap stamped "DEOTTE RPLS 4673" in the southeasterly line of the Permanent Utility
Easement described to the City of Fort Worth, recorded in D197015509 of the Deed Records of
Tarrant County, Texas (D.R.T.C.T.) being the POINT OF BEGINNING.
THENCE N 47"00'42" E, along the said southeasterly line of said Permanent Utility Easement, a
distance of 177.95 feet to a 5/8 iron rod set with plastic cap stamped "DEOTTE RPLS 4673" in
the east line of said Lot 6 and the west right of way line of Highway 287 (a variable width right of
way).
THENCE S 42037'04" E, along the east line of Lot 6 and said right of way line, a distance of
20.00 feet to a 5/8 iron rod stamped with "DEOTTE RPLS 4673".
THENCE S 47000'42" W, departing said east line of Lot 6 and said right of way line, a distance
of 177.43 feet to a 5/8 iron rod stamped with "DEOTTE RPLS 4673" in said common line of Lot

Commencing at a one inch iron pipe found at the beginning of a curve in the southeast line of

Tarrant County,Texas,for the Lake Arlington Lift Station and Force Main Project
RECOMMENDATION:
It is recommended that the City Council:
1. Amend Mayor and Council Communication 20-0752 to adopt resolution authorizing condemnation by eminent domain to acquire 0.266
acres in permanent sewer easements and a total of 1.060 acres for temporary construction easements from improved property owned by
Jerry Coyel, located southeast of the intersection of South Loop 820 and West Kennedale Parkway in the Oak Crest Addition, Block 10, Lots
4-6, David Strickland Survey and Shelby County School Land Survey in the City of Kennedale,Tarrant County,Texas;
2. Declare the necessity to acquire the described property interest for the Lake Arlington Force Main and Lift Station project;
3. Declare that negotiations between the City and the property owner to acquire 0.266 acres in permanent sewer easements and a total of
1.060 acres for temporary construction easements from improved property owned by Jerry Coyel,located southeast of the intersection of
South Loop 820 and West Kennedale Parkway in the Oak Crest Addition, Block 10, Lots 4-6, David Strickland Survey and Shelby County
School Land Survey,City of Kennedale,Tarrant County,Texas,were unsuccessful due to the inability to reach a mutually agreed upon value
for the property interest being acquired by the City;
4. Adopt the attached resolution authorizing the City to use its power of eminent domain to acquire the property for public use;
5. Authorize the City Attorney to institute condemnation by eminent domain proceedings to acquire the described property interest from the
property owner;
6. Authorize a payment pursuant to an award of commissioners or a negotiated settlement;and
7. Authorize the City Manager or his designee to accept and record the appropriate instruments.
DISCUSSION:
On October 20,2020,the City Council authorized condemnation by eminent domain to acquire 0.266 acres in permanent sewer easements and a
total of 0.990 acres for temporary construction easements for the Lake Arlington Force Main and Lift Station project(Mayor&Council
Communication(M&C)20-0752). However,after M&C 20-0752 was approved,a calculation error in the total acreage for temporary construction
easements on Parcel 14 was observed. Therefore,staff recommends that M&C 20-0752 be amended to add the acreage for Parcel 14-TCE2 in
the amount of 0.070 acres and increase the total acreage of the temporary construction easements to 1.060 acres.
The property rights in the improved subject property are required to construct public sewer improvements that will increase conveyance capacity
necessary to handle projected growth within the Village Creek Wastewater Basin. The Fort Worth Wastewater Master Plan recommends the
installation of a lift station and force main within the lower reaches of the Village Creek Basin. This new sewer improvement will be constructed for
public use and funds for this project were included within the Water&Sewer Capital Project 2018(W&S Capital Proj 2018)Fund proceeds. The
land rights in the improved subject property are needed for a new force main sewer line.
Staff made revised initial and final offers according to the permanent sewer easement acreages and temporary construction easement
acreages shown in the table below. Negotiations with the property owner were unsuccessful due to the inability to reach a mutually agreed upon
value for the property interests being acquired by the City.
Upon approval,a condemnation proceeding will be brought to acquire the permanent sewer easements and temporary construction easements on
the property.

Funding is budgeted in the Wastewater Department's W&S Capital Proj 2018 Fund for the purpose of funding the Lake Arlington, FM, LS and SS
project, as appropriated.
To approve this M&C,the Council Member making a motion to authorize condemnation by eminent domain should say:
"I move that the Fort Worth City Council adopt the resolution authorizing use of the power of eminent domain to acquire a total of 0.266 acres in
permanent sewer easements and a total of 1.060 acres for temporary construction easements from improved property owned by Jerry Coyel. The
property is needed for the Lake Arlington Lift Station and Force Main project,a public use that will construct public sewer improvements to
increase the conveyance capacity necessary to handle projected growth within the Village Creek Wastewater Basin. The property is located in the
Oak Crest Addition, Block 10, Lots 4-6, in the David Strickland Survey and Shelby County School Land Survey in the City of Kennedale,Tarrant
County,Texas. The property interests to be acquired are described by metes and bounds and depicted by survey exhibits attached to this Mayor
and Council Communication."
This property is located in the City of Kennedale near COUNCIL DISTRICT 5.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget,as previously appropriated, in the W&S Capital Proj 2018
Fund for the Lake Arlington, FM, LS and SS project to support the approval of the above recommendations and the purchase of the easements.
Prior to any expenditure being incurred,the Water and Property Management Departments have the responsibility to validate the availability of
funds.
