AN ORDINANCE VACATING, ABANDONING AND EXTINGUISHING
MOUNTAIN BROOK LANE, SITUATED IN THE CHISHOLM TRAIL RANCH
ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS, AS RECORDED IN INSTRUMENT NO. D222088926,
OFFICIAL PUBLICS RECORDS, TARRANT COUNTY, TEXAS, AND
CONTAINING APPROXIMATELY 39,056 SQUARE FEET OF LAND;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH,TEXAS:
SECTION 1.
That all of Mountain Brook Lane, a variable width right-of-way, situated in the J.J.
Albirado Survey, Abstract No. 4, located in the Chisholm Trail Ranch Addition, an
addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Instrument No.
D222088926, Official Public Records, Tarrant County, Texas, and containing
approximately 39,056 square feet or 0.8966 acres of land, and as more specifically
described in Exhibits "A," attached hereto and incorporated herein by reference, be and
the same is vacated, abandoned and extinguished.
SECTION 2.
That the easements to the land in the above-described vacated public alley rights
of way are hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land situated in the J.J.Albirado Survey,Abstract No.4,City of Fort Worth,Tarrant County,Texas and being all of
Mountain Brook Lane a variable width right of way,according to the plat of Chisholm Trail Ranch,an addition to the City of Fort Worth,
filed of record in Instrument No. D222088926 Official Public Records,Tarrant County,Texas,and being more particularly described as
follows:
BEGINNING at a 5/8-inch iron rod with plastic cap stamped"DUNAWAY'found at the north end of a comer clip for the intersection of
the west line of Summer Creek Drive(a 1204bot wide right-of-way)and the north line of said Mountain Brook Lane,same being the
southeast comer of Lot 1, Block 5,of said Chisholm Trail Ranch,for the beginning of a non-tangent curve to the left having a radius of
1,05B.76 feet,a central angle of 05"27'43",and a chord bearing and distance of South 16*40'17"West, 100.89 feet;
THENCE with said curve to the left,an arc distance of 100.93 feet to a 5/8-inch iron rod with plastic cap stamped"KHA"found at the
south end of a comer clip for the intersection of the south line of said Mountain Brook Lane and west line of said Summer Creek Lane,
same being the northeast corner of Lot 1,Block 6,of said Chisholm Trail Ranch,and the southeast corner of this tract;
THENCE with said south line,same being common with the north line of said Lot 1,Block 6 the following five(5)courses and distances:

Development in Chisholm Trail Ranch
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating Mountain Brook Lane to be replatted with the adjoining property for the Cottages of Summer Creek
multifamily development in Chisholm Trail Ranch;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Kimley-Hom Associates on behalf of ONM Living,has requested vacation of this right-of-way to be replatted with the adjoining property for the
Cottages of Summer Creek multifamily development.The City Plan Commission recommended approval of this request at its meeting on
September 14,2022.An acceptable final plat(FS-22-242)has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the street.
This project is located in COUNCIL DISTRICT 6.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
