The purpose of this Informal Report is to provide follow-up data and information to the IR 22-167
presented on the November 15, 2022 city council work session regarding the Curfew Ordinance for Minors,
specifically addressing current caseloads, and timing of case processing.
Curfew Ordinance
Under the current ordinance, a minor is defined as a person under 17 years of age. A violation is committed
if a minor remains in any public place or on the premise of any establishment within the city during curfew
hours. Curfew hours depend on the day of week and are listed below.
• Between 11:00 p.m. and 6:00 a.m. on Sunday, Monday, Tuesday, Wednesday, and Thursday
• Between 12:01 a.m. and 6:00 a.m. on Saturdays and Sundays

Case Summary
A breakdown of No-Plea Open cases is shown in Table 2:
• Forty-five (45) cases are open due to non-appearance by the parent and minor.
• Seventeen (17) cases are currently set for a hearing, and three (3) are pending to be calendared.
The snapshot in Table 3 shows the updated figures for FY2020, additional cases closed for FY2021, and
further case movement on FY2022 cases filed.
Case Process and Scheduling of Cases
Juvenile (minor) cases filed with the Municipal Court are by default, set to a Juvenile Arraignment Docket.
A parent, managing conservator, or custodian of a defendant under 17 must appear in open court with their
child. Article 45.057, C.C.P., provides that a child and parent required to appear before a court have an
obligation to provide the court in writing with the current address and residence of the child. The obligation
continues even after the child reaches age of 17.
Notice to Parents/Guardians
Notices that come back as undeliverable are researched by staff to determine if there is a more recent
address to summon the parent and minor. Dockets are calendared in Court 91 at least five days a month
with morning and afternoon dockets. Juvenile cases have been calendared for November and December.
The court is reviewing cases from this data set in which no response/appearance has been made by the
parent and minor. We will work with the Prosecutor's Office to discuss options to resolve historical cases
in more timely manner.

Case Reporting
Curfew violations for minors under the current city ordinance are not reported to any state agency.
Records of cases involving a juvenile, other than for traffic offenses, are confidential and may not be
disclosed to the public if the records relate to a charge, conviction, acquittal, dismissal, or deferred
disposition. No warrants are issued for persons who were under the age of seventeen (17) at the time the
citation was issued.
