SUBJECT: ROW ORDINANCE — CITATIONS FOR CONTRACTOR VIOLATIONS 1q irn { 1875 The purpose of this report is to inform City Council of staff's intent to develop a Right-of-way (ROW) Ordinance to allow City to issue citations to contractors for violations when working in the City ROW to protect the public, as well as protect against damage to City and private infrastructure. The City ROW becomes more and more congested each year due to population growth, increased demand for both public and private infrastructure, as well as technology advancements. Facilities located within the ROW are more susceptible to damage from construction within these congested corridors, resulting in the need for additional tools for use by the City to adequately manage our ROWs in order to minimize construction damage to existing infrastructure and its negative impacts on the public. At the request of City and Department leadership, ROW Management has collaborated with the Law Department and other departments that contract work within the ROW, to prepare a scope and schedule for development of a ROW Ordinance to accomplish the following: • Develop and implement ordinance to amend code to allow City to issue citations for certain violations in the ROW • Define citable violations and associated penalties Proposed citable violations include, but are not limited to the following: damaging public or private infrastructure; working in the ROW without permit authorization; and failing to comply with restrictions or requirements included in the permit intended to protect the public (examples - not requesting required utility locates, not securing temporary steel plating over open excavations, and providing improper traffic control). Staff will engage external stakeholders who contract work within the ROW, including the development community and utility service providers (examples — electric, gas and communication providers), as well as the contracting community. It is anticipated that the ROW Ordinance will be presented to City Council for approval on January 31 , 2022.
