SECTION "d. It shall be a condition of the r.d dit of said railway company to use and enjoy this grant and privilege to -cross said public streets that said railway company shall„ indemnify and save whole and harmless the City of Fort Arth from ally aa°id all manner of claims for damages, real or assert:.- ed, to person or property, aside against said City by reason of the nrigbts and privileges herein granted.
