HomeMy WebLinkAboutOrdinance 25920-12-2022 ORDINANCE NO.25920-12-2022 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CCPD CAPITAL PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PD SWAT VEHICHLE STORAGE PROJECT (CITY PROJECT NO. 101921) IN THE AMOUNT OF $600,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PD BOB BOLEN PROPERTY ROOM EXP PROJECT (CITY PROJECT NO. 101920) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager,there shall also be adjusted estimated receipts and appropriations in the CCPD Capital Projects Fund,by increasing estimated receipts and appropriations in the PD SWAT Vehicle Storage project (City Project No. 101921) in the amount of $600,000.00 and decreasing estimated receipts and appropriations in the PD Bob Bolen Property Room Exp Project (City Project No. 101920) by the same amount. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Felix Street,and Provide for Administrative Costs in the Amount of$294,602.00 and Design Costs in the Amount of$165,325.00 for a Total Project Cost of $1,880,606.00,Adopt Appropriation Ordinance and Amend the Fiscal Years 2023-2027 Capital Improvement Program RECOMMENDATION: It is recommended that the City Council: 1. Authorize the execution construction contract with West Fork Construction, LLC, in the amount of$1,420,679.00,for the new Special Weapons and Tactics Vehicle Storage Facility located at the Bob Bolen Public Safety Complex Administration, 505 W. Felix Street,and provide for administrative costs in the amount of$294,602.00 and design costs in the amount of$165,325.00 for a total project cost of $1,880,606.00; 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the CCPD Capital Projects Fund by increasing estimated receipts and appropriations in PD SWAT Vehicle Storage project(City Project No. 101921) in the amount of $600,000.00 and decreasing estimated receipts and appropriations in the PD Bob Bolen Property Room Exp project(City Project No. 101920)by the same amount;and 3. Amend the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The new Fort Worth Police Department's Special Weapons and Tactics(SWAT)Vehicle Storage Facility will be located at the Bob Bolen Public Safety Complex,505 W. Felix Street. This eight bay,5,500 square foot, storage facility will provide sheltered storage for expensive specialized vehicles that could be damaged by prolonged ultra violet exposure.This project is funded by Crime Control and Prevention District(CCPD). On July 28,2022 and August 4,2022,the City issued a Request for Proposals,and received four proposals for the project from general construction contractors.Three of these firms provided the required"Post Proposal—Pre Award Submittals"to be further evaluated by the City. Those firms were: • West Fork Construction, LLC • RJM Contractors, Inc. • Prim Construction, LLC The three complete proposals were reviewed by members of the Fort Worth Police Department,MMBE Office and the Property Management Department and were evaluated for best value based on the criteria set forth in the Request for Proposals.The selection team recommends award the construction contract to West Fork Construction, LLC. PROJECT TOTAL $1,880,606.00 On December 4th,2018, by Mayor&Council Communication(M&C G-19431),the City Council authorized increasing the estimated receipts and appropriations in the CCPD Capital Projects Fund for the purpose of funding capital improvement facility projects, including PD Bob Bolen Property Room Expansion project(City Project No. 101920)and PD SWAT Vehicle Storage project(City Project No. 101921).The action in this M&C is not included in the FY2023-2027 Capital Improvement Plan(CIP).Approval of this M&C will amend two existing projects that were implemented with the approval of M&C G-19431 by decreasing estimated receipts and appropriations in the PD Bob Bolen Property Room Expansion project(City Project No. 101920)in the amount of$600,000 and increasing estimated receipts and appropriations in PD SWAT Vehicle Storage project(City Project No. 101921)by the same amount.The Crime Control and Prevention District(CCPD)Board approved the use of$600,000 savings from PD Bob Bolen Property Room Expansion project(City Project No. 101920)for the PD SWAT Vehicle Storage project(City Project No. 101921)at the December 6th meeting. Building Maintenance-Property Management Department anticipates the annual operating impact for maintenance associated with this project, beginning in the third quarter of FY 2023,to be$33,600.00 annually. Waiver of Building Permits-In accordance with the City Code of Ordinances, Part 11,Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1,Exception 2;"Work by non-City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived." M/WBE OFFICE-WEST FORK CONSTRUCTION, LLC is in compliance with the City's Business Equity Ordinance by committing to 17% Business Equity participation on this project.The City's Business Equity goal on this project is 16%. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the PD Bob Bolen Property Room Exp project within the CCPD Capital Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the CCPD Capital Projects Fund for the PD SWAT Vehicle Storage project to support the approval of the above recommendations and execution of the construction contract. Prior to any expenditure being incurred,the Police Department has the responsibility of verifying the availability of funds.
