AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE TRANSPORTATION IMPACT FEES FUND IN THE
AMOUNT OF $80,030.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF THE
ALSBURY BOULEVARD PAVING AND DRAINAGE PROJECT; PROVIDING FOR
A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY`ITIE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Transportation Impact Fees Fund in the amount of$80,030.00, from available funds, for the purpose of the
Alsbury Boulevard Paving and Drainage Project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That t1-:i=is ordinance shall be cumulative of Ordinance No. 204 1 1-09-20 1 2 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Gayatri Savitir, Inc., Fort Worth Transportation Authority, and James Huck, LLC, for $71,030.00 and Pay
the Estimated Closing Costs of $9,000.00 for a Total in the Amount of$80,030.00 and Adopt Appropriation
Ordinance (COUNCIL DISTRICT 6)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Transportation Impact Fees Fund in the amount of$80,030.00 from available funds;
2. Authorize acquisition of a fee simple interest in three parcels for a total of 0.085 acres for right-of-way
and easement interest in two parcels for a total of 0.088 acres for permanent drainage easements for the
Alsbury Boulevard Paving and Drainage Improvement Project No. 01273, located East of 1-35W from
Gayatri Savitir, Inc., Fort Worth Transportation Authority, and James Huck, LLC;
4. Find that the total purchase price in the amount of$71,030.00 is just compensation; and
5. Authorize the acceptance of the conveyance, the recording of the appropriate instrument and payment
of the estimated closing costs in the amount of$9,000.00.
DISCUSSION:
The Alsbury Boulevard Paving and Drainage Project is necessary for increased traffic demand and to
provide added drainage capacity along Alsbury Boulevard and East of Interstate Highway 35W to Stone
Road.
An independent appraisal was acquired for each parcel and each property owner has agreed to the
appraised amounts. The real estate taxes will be pro-rated with each seller being responsible for taxes
due up to the closing date. The City will pay the total estimated closing costs in the amount of
$9,000.00. The real estate taxes will be pro-rated and the sellers will be responsible for any property
taxes due up to the closing date. Upon City Council approval, Staff will proceed with acquiring the fee
simple and easement interest in the properties set forth below except for the mineral estate. The deeds
will contain a surface waiver for the exploration of the mineral estate.
Funding for this project is being provided from the transportation impact fee revenues from Service Area
Z.
