SUBJECT 70 RECEIPT OF A GRANT FROM THE TEXAS SCHOOL SAFETY
CENTER/\T TEXAS STATE OND/EK8lTY-SANM&RCDS, FOR THE PURPOSE AF
OPERATIONS TO DISCOURAGE THE SALE OF TOBACCO PRODUCTS TO
MINORS; PROVIDING FOR A SBV2RABlLlTY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT' BEKBVV[T8� AND PROVIDING AN EFFECTIVE
DATE.

SECTION 1.
That in addition to d)mxe amounts allocated to the various City departments for Fiscal Year 2012-2013 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants
Fund \n the oroouoi of $60,000.00, subject to receipt of grant from the Texas School Safety Center at
Texas State University-San Marcos, for the purpose of operations to discourage the sale of tobacco products
to minors.
SECTION 2.
That should any portion, orudon or pad of section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent-1 urisdiction, such decision, opinion or j Lidgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, wtdtb said coouuiojug
pnuviuiuoo abu)|be and n:nuuin in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 2041 )-09-20}2 and all other ordinances and
appropriations amending the xunue except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Ratify Application for and Authorize Acceptance of a Grant, if Awarded, in the Amount Up to $60,000.00
from the Texas School Safety Center at Texas State University-San Marcos, Authorize Execution of
Related Agreement with Texas State University-San Marcos for Operations to Discourage the Sale of
Tobacco Products to Minors and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Ratify the application for and authorize acceptance of a grant, if awarded, in the amount up to
$60,000.00 from the Texas School Safety Center at Texas State University-San Marcos;
2. Authorize the execution of related Agreement with Texas State University-San Marcos for operations to
discourage the sale of tobacco products to minors; and
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in the amount of $60,000.00, upon receipt of the grant.
DISCUSSION:
The Texas School Safety Center at Texas State University-Sari Marcos coordinates the Tobacco
Enforcement Program, which is funded by the Department of State Health Services. This program awards
grants to local law enforcement agencies for the purpose of conducting controlled buys/sting operations of
tobacco permitted retail outlets. The controlled buys/sting operations are conducted in order to
discourage retailers from selling tobacco products to minors. If the City of Fort Worth's grant application is
approved, Texas State University-San Marcos will grant the City of Fort Worth Police Department funds in
the amount up to $60,000.00 to perform the sting operations.
FISCAL INFORMATION t CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations,
receipt of the grant, and adoption of the attached appropriation ordinance, funds will be available in the
current operating budget, as appropriated, of the Grants Fund.
