Ordinance No. 17165-09-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $44,360 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING CHANGE ORDER NO. 7 TO CITY SECRETARY CONTRACT NO. 33665 WITH TRI-TECH CONSTRUCTION, INC.; PROVIDING FOR A SEVERABIL,6TY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE !T ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2Q05- 2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $44,36t] from available funds, for the purpose of executing Change Order Na. t to City Secretary Contract No. 33665 with Tri-Tech Construction, Inc. SECTION 2. That should any portion, section ar part of a section of this ordinance he declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. '16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such ether ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. ADOPTED AND EFFECTIVE: September 19, 2006 This ordinance shall take effect upon adoption. Adapt the attached appropriation ordinance increasing appropriations in the Culture and Tourism Fund by $44,360.00, and decreasing the unreserved, undesignated fund balance by the same amount; 2. Authorize the transfer of $44,360.00 from the Culture and Tourism Fund to the Specially Funded Capital Projects Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $44,360.00, from available funds; 4. Authorize the City Manager to execute Change Order No. 1 to City Secretary Gantract No. 33665 with Tri-Tech Canstructinn, Inc. in the amount of $44,360.00 far increased and additional pay item quantities, thereby increasing the contract amount to $439,785.00. DISCUSSION: On June 13, 2006, {M&C C-21501) the City Council authorized the City Manager to execute a contract with Tri-Tech Construction, Inc. in the amount of $395,425.00 far Storm Drain Improvements an 14th Street (Thrnckmorton Street to Houston Street), Throckmvrton Street (13th Street to 14th Street) and Houston Street (13th Street fa 14th Street}. The project consists of the installation of a storm drain system on the identified streets to facilitate the Canstruction of the Omni Hotel and the City parking garage, both of which will be located west of the Fort Worth Convention Center: Change Order No. 1 will provide for the following: • Increased pay item quantities of flawable fill, brick pavement repair and trench excavation and backfill and extra width pavement repair that are necessary due to actual field conditions encountered during construction. g Replacement of the severely deteriorated shallow 8-inch water main located across the 13th StreetlThrockmartan Street intersection with a 12-inch pipe at a deeper elevation to match the existing 12-inch water main at bath ends of the identified 8-inch pipe segment. • Removal of the underlying high strength Concrete backfill for the existing utilities an 14th, Houston and Thrackmortan Streets in order to allow for the installation of the proposed storm Lagname: 301A~TH-TTC COl Page 1 oft drain system. Staff considers the change order amount to be fair. The project is located in COIJNCfL DISTRICT 9, Mapsco 77A. FISCAL. INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption ofi the attached apprapria#i0n ordinances, funds will be available in the current capital budge#, as appropriated, afi the Specially Funded Capital Projects Fund. The unreserved, designated fund balance of the Culture and Tourism Fund will be $11,350,030 after this appropria#ion.
