CITY SECRETARY CONTRACT No 444 INTERLOCAL AGREEMENT Thi agreement made and entered into this, the ( OIL day of 1990, by and between the Town of Haslet, a political subdivision organized and existing under the laws of the State of Texas, acting herein by and through its governing body and through its duly authorized Mayor, hereinafter referred to as "Haslet" and the City of Fort Worth, a home -rule municipal corporation duly organized and existing under the laws of the State of Texas, acting herein by and through its duly authorized City Manager, hereinafter referred to as "Fort Worth". WHEREAS, this Agreement is made under the authority granted by and pursuant to Article 4413 (32c), V.T.C.S, known as the Interlocal Cooperative Act; and WHEREAS, the parties, in paying for the performance of governmental functions or in performing such governmental functions, shall make payments therefor only from revenues legally available to such party; and WHEREAS, the governing body of each party finds that the project or undertaking is necessary for the benefit of the public and that each party has the legal authority to build the project or to provide such service, and the construction and improvement thereof is in the common interest of both parties hereto; said project being more particularly described as the construction of a 16-inch water line across and from Fort Worth Alliance Airport to the Exhibit "A", which is attached hereto and for all intents and purposes. -1- boundary limit of the Town of Haslet, as shown on incorporated herein OITICiAi crra�,s,�.'a .Vir For and in consideration of the mutual undertakings herein- after set forth and for adequate consideration given, the parties agree as follows: I. Fort Worth shall cause to have constructed a 16-inch water line from and across the Fort Worth Alliance Airport extending to the city boundary line of Haslet, more particularly shown on Exhibit "A". Fort Worth shall further cause to be installed a 10-inch meter to which Haslet may connect its water system for delivery of treated water; provided, however, that Haslet shall not be permitted to withdraw treated water from such meter until it executes a contract for water service with Fort Worth. Fort Worth shall also cause to be installed at the meter location the SCADA system for the purpose of reading and monitoring said meter. The estimated construction and installation costs of such improvements is $139,000.00, and the estimated share of Haslet's cost is $68,600. These estimates shall be adjusted upward or downward based upon actual construction and installation costs incurred. II. Haslet agrees to pay to Fort Worth its share of the actual construction and installation costs, irrespective of whether or not it elects to enter into a contract for water service with Fort Worth, over a ten-year period of time, in ten (10) equal installments of principal and interest, the first such payment being due and payable to Fort Worth one year from the date the construction and installation of the improvements are completed. -2- The principal indebtedness shall accrue interest at the rate of 7.2520690% per annum. Operation and maintenance of the line on the Fort Worth side of the meter shall be the sole responsibility of Fort Worth. Operation and maintenance of the line on the Haslet side of the meter shall be the sole responsibility of Haslet. IV. By entering into this agreement the parties do not create any obligations, expressed or implied, other than those set forth herein, and this contract shall not create any rights in parties not signatories hereto. DISCUSSION: Contracts for wholesale water service with eighteen customer cities and boards were approved by Council on June 27, 1989. In addition, contracts with the Benbrook Water and Sewer Authority and Dalworthington Gardens were subsequently approved by Council in August and October, 1989, respectively. The Town of Haslet has had no previous water contract with the City of Fort Worth; therefore, a metering station and water line had to be constructed in order to provide them with water service. Haslet's portion of the costs of the construction and installation of the improvements will be repaid over a ten year period.
