Ordinance No. '17170-09-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJI=CTS FUND 1N THE AMOUNT OF $830,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE FORT WORTH PUBLIC ART PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DAT1=. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SI=CTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $830,000 from available funds for the purpose funding the Fort Worth Public Art Pragrarn. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in foil force and effect. SECTION 3. That this nrdinance shall be cumulative of Ordinance Na. 16582 and ail other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. 51=CTION 4. Authorize the transfer of $830,OOO.DD from the FY2005-06 Water and Sewer Operating Fund to the Specially Funded Capital Projects Fund for the Water Department contribution to public art funding; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $830,ODD.00, from available funds. DISCUSSION: On October 2, 2001, {M&C G-13396) the City Council adopted Ordinance No. 14794 creating the Fart Worth Public Art Program. The purpose ofi the Fart Worth Public Art Program is to: • create an enhanced visual environment for Fort Worth residents; • commemorate the City's rich cultural and ethnic diversity; • integrate the design work of artists into the development ofi the City's capital infrastructure improvements; and promote tourism and economic vitality in the City through the artistic design of public spaces. In accordance with Council policy established in that ordinance, two percent of the annual operating budget of the Water and Sewer Fund for cash financing of capital projects is allocated for public art in the City. This two percent is set aside an an annum basis for the Fort Worth Public Art Program. Public art is also fiunded via a two percent set aside of General Obligation {GO) bonds. Specifiic art projects in the Fart Worth Art Commission (FWAC) Annual Warlc plans and the Long-Range Public Art Plans for the 2D04 Capital Improvement Program and Water Fund are funded from that set-aside of GO bond and Water and Sewer Operating Fund capital improvement funds. The Lang-Range Public Art Plan for the 2D04 Capital Improvement Program was approved by Council an May 17, 2005, {M&C G- 14801}. The Long Range Public Art Plan for the Water Fund was approved by Council on May 9, 20D6, {M&C G-15185}. The FWAC's FY2006-D7 Work Plan of specific projects will be forthcoming with the M&C for the Arts Council's FY2006-07 Fort Worth Public Art Program management contract. Band funds cannot be used for public art conservation activities; therefore, as laid out in the approved Long Range Public Art Plan far the Water Fund, beginning in FY2DD5-06, funds totaling $2DO,OOD were set aside to start the Public Art Conservation Fund. Based an the strategy authorized via that long-range plan, a portion of the funds from the Water Department`s annual contribution fior public art would be directed to the conservation fund to cover conservation casts associated with the growing City art collection. In addition to the transfer of Water and Sewer Fund monies to the Specially >= unded Capital Projects Fund for public art designlfabricationlinstallation, this M&C also serves to add those additional funds to the established pool of funds for art conservation activities.
