Home My WebLink AboutOrdinance 25945-01-2023 ORDIANCE NO.25945-01-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE INTERGOVERNMENTAL CONTRIBUTION FUND, IN THE AMOUNT OF $2,690,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE CAMP BOWIE BOULEVARD IMPROVEMENTS PROJECT (CITY PROJECT NO. 104639); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Intergovernmental Contribution Fund in the amount of$2,690,000.00, from available funds,for the purpose of funding the Camp Bowie Boulevard Improvements project(City Project No. 104639). SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of an Interlocal Agreement with Tarrant County for reimbursement of eligible city costs in an amount not to exceed $2,690,000.00 for the Camp Bowie Boulevard Improvements project(City Project No. 104639); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Intergovernmental Contribution Fund in the amount of$2,690,000.00 for the purpose of funding the Camp Bowie Boulevard Improvements project(City Project No. 104639); 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements 2008 Fund in the amount of$463,162.00,from available funds,for the purpose of funding the Camp Bowie Boulevard Improvements project(City Project No. 104639); 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the 2007 CritCapProj-CO2013A Fund in the amount of$6,836,838.00,from available funds,for the purpose of funding the Camp Bowie Boulevard Improvements project(City Project No. 104639); and 5. Amend the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication(M&C)is to authorize the execution of an interlocal agreement(ILA)with Tarrant County,in an amount not to exceed$2,690,000.00 to provide reimbursement funding from Tarrant County for the Camp Bowie Boulevard Improvements project(City Project No. 104639). This roadway improvement will be delivered as a public-private partnership between Crescent Real Estate,LLC (Crescent)and the City of Fort Worth.Camp Bowie Boulevard,between Montgomery Street and University Drive is a four-lane divided arterial in a historic area with some areas including historic brick pavement. The project includes the following improvements in this section of Camp Bowie Boulevard: a limited amount of brick pavement repair utilizing historic brick from the City stockpile, panel repair of existing concrete turn lanes and median crossings,new 10- foot sidewalks, new Americans with Disabilities Act(ADA) ramps,street and pedestrian lighting,enhanced landscaping,restriping of pedestrian crossings and other street markings as necessary. Asphalt paving within these roadway limits will not be improved as part of this project. The City and Crescent Real Estate, LLC intend to enter into a Community Facilities Agreement(CFA)with City participation in construction and inspection costs.for the improvements.City participation is limited to a not to exceed total of$9,990,000.00. Funding for this project was not included in the Fiscal Years(FY)2023-2027 Capital Improvement Program. The action in this M&C will amend the FY2023-2027 Capital Improvement Program as approved in connection with Ordinance 25773-09-2022.
