HomeMy WebLinkAboutOrdinance 17175-09-2006Ordinance No. 17175-09-2006 AN ORDINANCE INCREASING ESTIMATEb RI=CEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $47,669,50 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $30,258.62 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING AN ENGINEI=RING AGREEMENT WITH BROWN & GAY ENGINEERS, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON MERRITT STREET, PRIDDY LANE AND WESTWIND DRIVE (PROJECT NUMBER 00452}; PROVIDING FOR A SEVRABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $47,669.50 and the Sewer Capital Projects Fund in the amount of $30,258.62 from available funds far the purpose of executing an Engineering Agreement with Brown & Gay Engineers, Inc., for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Merritt Street, Priddy Lane and Westwind Drive (Project Number 00452). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all ether ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $77,928.12 from the Water and Sewer Operating Fund to the Water Capital Projects 1=und in the arnaunt of $47,669.aQ and Sewer Capital Projects Fund in the amount of $30,258.62; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects f=und in the amount of $47,669.50 and the Sewer Capital Projects Fund in the amount of $30,258.62, from available funds; and 3. Authorize the City Manager to execute an engineering agreement with Brown & Gay Engineers, Inc., in the amount of $140,408.00 far pavement reconstruction and water and sanitary sewer main replacement on Merritt Street, Priddy Lane and Westwind Drive. DISCUSSI®N: The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction on Merritt Street (White Settlement to 150' North of Melbourne), Priddy Lane (White Settlement to Melbourne) and Westwind Drive (Lake Country Drive to Skylake Drive). This project consists of the preparation of plans and specifications for the repiacement of water and sanitary sewer mains and pavement reconstruction an the above identified streets. Brown & Gay Engineers, Inc., proposes to perform the necessary design work for a lump sum fee of $140,408.00. City Staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount $23,192.34 (water: $6,187.50; sewer: $3,799.62; and streets: $13,205.22) is required far project management by the Engineering Department. Brown & Gay Engineers, Inc., is in compliance with the City's M/WBE Ordinance by committing to 19% MNVBE participation. The City's goal an the project is 17%.
