STREET AND PORTIONS OF SUNDRY OTHER STREETS , AVEN"JES AND F1 BLIC PLACES IN THE C11Y OF FORT WORTH:, TEXAS, DECLARING' TIME CONTRACT WITH TEXAS B11MITHIC COMPANY FOR Ta C014STRUCTION OF SAID IMPROVE ANTS FULLY COMPLETED AND MRFORMED; DIRECTING THE ISSUANCE,, EXECUTION AND DELI'VERY OF CERTIFICATE'S IN EVIDENCE OF SPECIAL, ASSESS14EIM LEVI-ED AFTER GIVING EFFECT TO 31MDRY CREDITS M.REIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRE(I"TING THE Cll',rf SECREJ,'ARY '1`0 ENGROSS AND ENROLL THIS ORDINANCE BY CO'FfING THE CAP'TF.ON OF SAM, IN 7IC MIMITE BOOK OF THE'" CITY COIJNCIL OF FORT WOR147H,, TEXAS, AND BY F11LING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE REC;ORDS OF' SAID CIM, AND PROVIDING AN EFITCTIVE DATE, WHEREAS., the City of Fort Worth, Texas, has heretofore entered into a contract with for the making and construction of certain street improvemenLn oK� the hereinafter describad portions of streets, avenues and public places in said City, to-wit° WEST PETER SMITH S7,11FET From Forest Park Boulevard Lo Fifteenth Avenue, known and designgted as Project No. 104-35000-361. 1vREREAS, 'by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 7141 ., a portion of the cost of said improvements was levied .and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort �,orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 7 141, ,, and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAj, THAT I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be., and it is hereby, found and declared fully completed and performed. Ii. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment., the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Project Description Name: West Peter Smith Street from Forest Park Blvd. to 15th Avenue Project No. 104�-35000-361 Contractor: Texas Bitulithic Company Contract Awarded: January 20, 1975 (M&C C-3007) Work Order Issued: Match 20, 1975 Work Order Effective: April 7, 1975 Work Began: April 7, 1975 Date of Final Inspection and Approval: November 24, 1975 Working Time Bid: 52 Working Days Working Time Used: 63 V.1orkin.-, "Days Project Cost and Financing Original Bid Price: $91,372.85 Final Contract Cost: $98,604.00 Partial Payments Previously Made: 7 ($87,737w63) Final Payment Due: $10,866.37 Sufficient funds are available for the final payment to be made from Project Number 104-35000-361. Contract 'Time Monthly statement of contract rime charged shows the contractor used 11 working days in addition to the time allotted in the contract docu- ments. However, the project required more work and material than anticipated in the contract. Subsequently, in accordance with the contract specificatiops, the contractor is due additional time for the additional work; also, the contractor was delayed and could not properly schedule his work due to the railroad crossing adjustment DATE REFERENCE SUBJECT: Final Payment - West Peter Smith PAGE NUMBER Street From Forest Park Blvd. to 15th 2 2 2/9/76 FP-1127 Avenue of work performed by the railroad. In cooperation with the City, the con- tractor has maintained barricades on the project for the past two months after their work was complete in order that the street could be opened to local traffic until such time as the railroad finishes signalization of the crossing. Consequently, the contractor is due the additional working time required to complete the project. Deviation from Bid Price The final contract cost of the project is $7,231.15 over the Bid Price. The major portion of the increase, $8,178, resulted because during preparation of the quantities shown in the proposal of the contract documents, the quantity of r,iprap required to construct the work for the limits shown on the plans was miscalculated. A savings of $500.00 resulted because it was not necessary to adjust utilities as anticipated and a savings of $446-85 resulted due to minor variations between quan- tities estimated in the contract specifications and quantities measured and used at the job site. Compliance with Specifications Tests made during construction show materials used and the thickness of pavement is in compliance with contract, specifications. Recommendation It is recommended that the project described be accepted by adoption of an ordinance and final payment of $10,866.37 be made to Texas Bitulithic, Company.
