WHEREAS, The City of Fort Worth and Elements of Architecture, Inc., (Consultant)
made and entered into City Secretary Contract No. 56870 (The Contract) which was
admiratively authorized for $39,410.00 for design services and did not include the
reimbursable expenses as noted in Consultant's proposal, the 17th day of December,
2021, for Scrap Metal Area Modifications at the Old Hemphill Drop-Off Station; and
Amendment No. 1 was administratively executed in the amount of $3,200.00 for
reimbursable expenses that were inadvertently omitted in the Consultant's proposal;
and
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for modification of construction documents to include scope
of work changes;
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional design & construction administration services for the Old
Hemphill Drop-Off Station. The cost of this additional services is $55,801.00
and no additional reimbursable expenses. The scope of services is described
more fully in Elements of Architecture, Inc.'s Letter dated December 8, 2022
(Revised) subject: Proposal for A/E Services — Hemphill Scrap Metal Yard —
Amendment#2, Add Sery 01 — Extended Paving and Retaining Walls.

Article II — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "B". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "B". However, the total fee paid by the City shall
not exceed a total of $98,411.00 unless the City and the Consultant mutually
agree upon a fee amount for additional services and amend this
Agreement accordingly."

Add Sery 01 - Extended Paving and Retaining Walls
Dear Alfonso;
Elements is pleased to provide to you this Additional Services proposal for A/E services associated with the
Scrap Metal Yard for increasing the pavement areas as discussed in site meetings on March 24, April 19,June
16 and various communications. These improvements will require an updated survey to the added areas, new
retaining wall designs, guardrails, additional heavy duty equipment parking &paving design, updated
Landscape/Irrigation/Urban Forestry improvements. This additional services proposal also includes current
effort to date to discuss the scope and feasibility, producing preliminary site plan sketches for discussion, percent
coverage and impervious area analysis, zoning update verification, floodplain research, OPCC, general
compactor equipment planning and circulation study, subsequent meetings and discussions, etc. We have
defined our additional scope of services beyond the original project scope as follows:
SCOPE OF SERVICES
Construction Documents Phase
1. Scoping meetings, produce preliminary site plan sketches for review, perform percent coverage and
impervious area analysis, floodplain research, preliminary OPCC, compactor equipment and circulation
study(services already completed).
2. Revise the current Scrap Metal drawings&specifications to reflect the new expanded paving areas and
retaining walls as shown in attached exhibit dated 9-13-2022 and Revised 10-24-2022.
3. Attend 4 additional design phase meetings with Owner.
A. Submit Substantially Complete documents for Owner's Review.
5. Address Owner Review comments and submit final sealed construction documents.
Exclusions and Qualifications to This Proposal:
1. Proposals for civil, structural and cost estimating consultants are attached with the information included as
if provided within this proposal.

2. We have not included MEP Engineering, nor do we believe these are required for these additional
services. If we see that these are needed, we will provide a proposal for these services.
3. This proposal is based on the remaining design phase efforts being complete within two months of NTP.
If this phase extend beyond these anticipated schedules, we will provide a proposal for these extended
services.
A. This proposal excludes a pre-engineered shade canopy structure at the recycling center.
5. This proposal is based on 1 new APC 526 pre-crusher compactor with a 40YD receiver box. The final
compactor equipment to be purchased by the COFW will need to be tested for operational circulation
against the final engineered site plan prior to procurement.
6. We have not included cost estimating within this proposal or the additional CA phase services.

amount is in addition to our original proposal.

Expenses
We do not expect reimbursable expenses to be needed for these services and that we have adequate fee within
our original scope.
