Ordinance No. 17182-09-2006 AN ORDINANCE INCRI=ASWG ESTIMATED RECI=IPTS AND APPROPRIAT(DNS [N THE GRANTS FUNb IN THE AMOUNT OF $198,000 FROM A SURFACE TRANSPORTATION PROGRAM GRANT AMENDMENT FROM THE FEDERAL HIGHWAY ADMINISTRATION FOR THE PURPOSE OF FUNDING THE DESIGN AND CONSTRUCTION OF NEIGHBORHOOD TRAIL CONNECTIONS TO THE TRINITY RIVER TRAIL SYSTEM; PROVIDWG A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $198,000 from a Surface Transportation Program Grant Amendment from the Federal Highway Administration for the purpose of funding the design and construction of neighborhood trail connections to the Trinity River Trail System. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct confilict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to accept a Surface Transportation Program Grant in the amount of $198,000.00 from the Federal Nighway Administration for the construction of neighborhood trail connections to the Trinity River Trail System; 2. Authorize the City Manager to execute Advance Funding Agreement Amendment No. 2 with the Texas Department of Transportation {TxDOT); and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $198,000.00. DISCUSSION: On June 3, 2003, {M&C G-13989) the City Council adopted the Trinity River Vision Master Plan as a guide for future development along the Trinity River and its major tributaries. The vision of the master plan is to preserve and enhance the river and its corridors, so they remain essential greenways for open space, trails, neighborhood trail connections, wildlife and special recreation areas. The master plan recommends increased connections to adjacent neighborhoods and parks throughout the City. As a result of the Trinity River Vision Plan the City of Fort Worth has received $500,000 in 2003, $470,209 in 2004, $496,000 in 2005, and this 2006 allocation of $198,000, totaling $1,664,209. The Foster/Kellis Park connection and design study has had funding allocated and a balance of $1,462,798.50 is available for design and construction of future high priority neighborhood trail connectors. These funds will be committed to specific trail connections upon completion of the current design study. This study and public input process are scheduled to be completed by late January 2007. At that time, staff will bring the recommendations to the City Council far review, input and approval. The scope of this project is CITYWIDE.
