AMENDMENT No . 7
TO CITY SECRETARY CONTRACT No. 52483
WHEREAS, the City of Fort Worth (CITY) and Halff Associates,
Inc. (ENGINEER) made and entered into City Secretary Contract No. 52483,
(the CONTRACT) which was authorized by M&C No.C-29147 on the 11 day of
June, 2019 in the amount of $ 930,000.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1
in the amount of $27,000.00 which was administratively authorized on the
23 day of June, 2020; Amendment No. 2 in the amount of $37,000.00 which
wasadministratively authorized on the 2 day of September, 2020; Amendment
No. 3 in the amount of $35,945.00 which was administratively authorized on
the 28 day of December, 2020; Amendment No. 4 in the amount of $36,700.00
which was authorized by M&C No.21-0219 on the 14 day of April, 2021;
Amendment No. 5 in the amount of $56,841.00 which was administratively
authorized on the 25 day of October, 2021; Amendment No. 6 in the amount
of $428,665.00 which was authorized by M&C No.21-0996 on the 14 day of
December, 2021, and
WHEREAS, the CONTRACT involves engineering services for the
following project:
CentrePort Trail Phase I and Phase II project, CPN 100082; and
WHEREAS, it has become necessary to execute Amendment No. 7 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by ENGINEER totals $22,000.00. (See Attached Funding
Breakdown Sheet, Page -4-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to ENGINEER for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,574,151.00.

All other provisions of the Contract, which are not expressly

design services for the CentrePort Trail Phase 1 within the City of Fort Worth city limits.
This proposal includes the services as described in the Scope of Services (Attachment A). The Exclusions
(Attachment B) list services which are not included in this proposal but can be provided by Halff upon
request.

ATTACHMENT A
ENGINEERING SERVICES for
CENTREPORT TRAIL PHASE 1: 100% REVISED CONSTRUCTION DOCUMENTS
PURPOSE
Halff Associates, Inc. (ENGINEER) will provide the additional engineering services listed in Task 1 for
Centreport Trail Phase 1 (PROJECT) for the City of Fort Worth and TxDOT (ADMINISTRATOR). This
contract amendment incorporates City of Fort Worth alignment updates received after the 100%
package was submitted. The basic scope of services supplements the scope of services outlined in the
Professional Services Agreement dated July 2, 2019. The services to be provided as part of this
amendment are as follows:
ASSUMPTIONS
The scope of services for this proposal has been prepared using the following assumptions as a basis for
its preparation:
It is assumed that the following items are included in the proposed trail alignment and this
scope confirmation:
1. The sidewalk adjacent to Trinity Boulevard will be widened to 10 feet, where applicable. It may
be infeasible to provide a 10-foot wide sidewalk throughout the entire length along Trinity
Boulevard due to existing constraints such as power poles, existing ROW, traffic signals, existing
retaining walls, etc. Sidewalk crossings at the existing driveways will need to remain as designed
on the 100% submittal due to existing driveway grades.
2. Drawings included in this Contract Amendment will be integrated with the trail construction
drawings as a continuation of the scope of services stated in the Professional Services
Agreement (PSA) dated July 2, 2019.
3. Utility adjustments necessary to accommodate the sidewalk widening will be coordinated by the
City.
4. Existing survey will be utilized for the Trinity Boulevard sidewalk revisions.

BASIC SCOPE OF SERVICES
TASK 1— TRINITY SIDEWALK MODIFICATIONS
ENGINEER will revise the Trinity Boulevard sidewalk to provide a 10-foot wide sidewalk except in areas
where it is necessary to use a narrower width due to the existing constraints. The following tasks are
included in this scope of services for this effort:
• Revise the sidewalk width from the beginning of the project to the beginning of the 12-foot wide
trail section. The current centerline and profile will be used for these revisions. Driveways will
remain as designed on the previous submittal.
• Revise the wall design for Wall A and Wall B to accommodate the 10-foot wide sidewalk.
• Revise the Paving, Structural, Removal, and Erosion sheets to accommodate the 10-foot wide
sidewalk.
• Update the quantities and bid form to reflect the plan revisions.
BASIS OF COMPENSATION (City of Fort Worth)

A. Basic Fee Services:
The basis of compensation for Basic Fee services shall be as follows:
Task 1— Trinity Sidewalk Modifications $22,000

B. Billing Schedule:
The compensation for tasks listed as Basic Services in the compensation schedule shall be Lump Sum,
and the services for each Basic Service task shall be invoiced on a percent complete basis. The
compensation for tasks listed as Special (hourly/unit) Services in the compensation schedule shall be on
the basis of 2.3 times full (total) salary cost for the time each employee is engaged directly on the
project. Total fees will not be exceeded without prior approval. Direct costs associated with Special
Services, including printing and reproduction, postage, and courier/overnight service, will be considered
reimbursable and will be billed at 1.1 times the direct cost incurred. The project will be billed to
CLIENT/OWNER on a monthly basis.

EXCLUSIONS

The following services are not included in the scope or fees for this proposal; but can be provided by
Halff Associates, Inc., subject to negotiation:
General:
1. Any additional work not specifically included in the Proposed Scope of Work will be
accomplished as Additional Services.
2. Client generated changes to the design once Construction Document Preparation is in
progress. Time will be billed at fee base per task, per a proposal approved by the CLIENT, until
the work is at the same level of completion as it was prior to the change.
3. Revisions to the plans requested by the CLIENT after the plans are approved, unless
necessitated by discrepancy and inaccuracy in the surveys and plans.
4. Design of areas outside the limits of the defined project site.
5. Design of gas, telephone or other utility improvements.
6. Traffic engineering reports or studies.
7. Extra Public meetings or hearings not specified in the original scope of services described in
the Professional Services Agreement dated June 11, 2019.
8. Additional graphic products.
9. Additional meetings or workshops not identified in the project scope of services.
10. Permit fees, filing fees, pro -rated fees, impact fees, taxes, federal and/or state regulatory
agency review fees.
11. Printing of additional drawings, specification and contract documents not identified in the
project scope of services.
12. Construction staking.
13. Permit fees, filing fees, pro -rated fees, impact fees, taxes, federal and/or state regulatory
agency review fees.
14. Preparation and printing of As -Built Drawings.
15. Design/coordination of existing utility relocations or modifications, unless necessitated by
discrepancy and inaccuracy in the surveys and plans.
16. Extra negotiations with adjacent property owners not specified in the original scope of
services within the Professional Services Agreement dated June 11, 2019, or as described
below within the "Trail Width Study/Easement Acquisition and Coordination" section.
17. Additional TxDOT or regulatory agency requirements not identified in the proposed scope of
services.
18. Technical reports for the following items are excluded from this scope of services: noise, air
quality, community impacts, indirect impacts, and cumulative impacts, unless necessitated by
the completion of the CE process.
19. Effort to obtain right -of -entry from public or private landowners to allow for the completion of
environmental services is not included in this scope of work.
20. This scope of work does not include threatened or endangered species surveys of Section 7
consultation with the USFWS under the Endangered Species Act, unless necessitated by the
completion of the CE process.

21. If TxDOT or a regulatory agency requires additional information other than standard
information and submittals required for the completion of this project, then a supplemental
services agreement will be required.
22. Electrical Engineering is not included.
23. Traffic Signal modifications are not included.
24. Irrigation is not included.
25. Bridge Inspection Services.
26. Geospatial Survey services.
27. Additional Geotechnical Services including additional borings, direct shear testing, triaxial
testing, global stability analyses, re -mobilization, and permitting are excluded.
28. Any redesign of driveways or sidewalk crossings, including addition of driveway profiles or
updating spot grades are excluded.
29. Any additional easement or ROW documents needed from any of the above revisions are
excluded.
30. Design of new walls and/or revisions to previously -design walls other than Wall A and B are
excluded.
