HomeMy WebLinkAboutOrdinance 25948-01-2023 ORDINANCE NO.25948-01-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND,SUBJECT TO RECEIPT OF THE GRANT, IN THE AMOUNT OF $33,000.00, FOR THE PURPOSE OF FUNDING COSTS ASSOCIATED WITH THE REPLACEMENT OF AGING LABORATORY EQUIPMENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund,subject to the receipt of the grant, in the amount of$33,000.00, for the purpose of funding costs associated with the replacement of aging laboratory equipment through the Edward Byrne Memorial Justice Assistance Grant from the U.S. Department of Justice, Office of Justice Programs and Bureau of Justice Assistance. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize Amendment to Mayor and Council Communication 22-0172 to revise the grant type,award type,and appropriations type of the application for,and authorize acceptance of, if awarded,the Edward Byrne Memorial Justice Assistance Grant from the United States Department of Justice, Office of Justice Programs and Bureau of Justice Assistance to the pass-thru entity of the Texas Office of the Governor,Criminal Justice Division Fiscal Year 2023 Criminal Justice Grant Program in an amount of$33,000.00 to Replace Aging Crime Laboratory Equipment; 2. Authorize the execution of a grant agreement with the Texas Office of the Governor, Criminal Justice Division; 3. Reaffirm the attached Resolution for acceptance of grant funds in an amount of$33,000.00 and to make assurances as required by the Criminal Justice Grant Program;and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund, subject to receipt of the grant, in an amount of$33,000.00,for the purpose of funding costs associated with the replacement of aging laboratory equipment. DISCUSSION: The approved Mayor&Council Communication (M&C)22-0172 is being amended to reflect the following changes: 1. Award type from the Office of the Governor, Public Safety Office, Criminal Justice Division to the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; 2. Grant type from direct funds from the Office of the Governor to pass-thru entity of the Texas Office of the Governor;and 3. Appropriations type from Grants Operating State funds to Grants Operating Federal funds. The Fort Worth Police Department Crime Laboratory(FWPD-CL)has applied for program funding in the amount of$33,000.00 for costs associated with the replacement of aging laboratory equipment, including hydrogen generators or similar. If awarded,the FWPD-CL will purchase two hydrogen generators to test evidence for the presence of substances that are controlled by federal and state law,as well as test driving under influence/driving while intoxicated(DUI/DWI)samples to determine the blood alcohol concentration during the Fiscal Year 2023 Grant Cycle. The FWPD-CL Chemistry Unit provides evidence testing services at the request of the Fort Worth Police Department and the Tarrant County Criminal District Attorney's Office.Aging equipment and equipment failure could negatively impact case turnaround time and backlog,causing the results of said tests to be delayed to our law enforcement and criminal justice stakeholders for the successful prosecution of narcotic cases. Funding for this project will improve the criminal justice system by contributing to the FWPD-CL Chemistry Unit's ability to do casework in a timely manner through the usage of property functioning equipment. Matching funds are not required under the grant.The funding type is reimbursement. Indirect costs are allowable costs in this grant.The budget will include indirect costs if applicable. The grant will serve ALL COUNCIL DISTRICTS. A Form 1295 is not required because: This contract will be with a governmental entity,state agency or public institution of higher education:Texas Office of the Governor FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current operating budget,as appropriated, in the Grants Operating Federal Fund. The Police Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City.
