AN ORDINANCE ACS NDiNG SECTION 9-A OF ORDINANCE
NO. 3011, BEING AN AMENDNENT TO THE ZONING
ORDINANCE OF THE CITY OF FORT 1OM, MSCRIB-
ING A SAVINGS CLAUSE; PROVIDING A PENALTY FOR
THE VIOLATION OF ANY SECTION OF THIS ORDINANCE
OF 140T LESS THAN FIVE DOLLARS (05.00) NOR MOVE
THAN TWO HUNDRED DOLLARS ($200.00); PROVIDING
EACH DAY THE VIOLATION CONTINLES, SHALL BE A
SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEM:
SECTION 1.
That Section 9-A of Ordinance No. 3011 be and. the same is hereby amended.
SECTION 2.
That SECTION 9-A, WF_R",RESTRICTED COMERCIAL DISTRICT, USE REGULATIONS,
be amended to include the following use:
3a: BOWLING ALLEYS, if conducted wholly within a completely enclosed
building provided such building shall be so constructed and operated that noise
or vibration created by activities within the building shall not be perceptible
beyond the property line.
SECTION 3.
If any section, subsection, sentence, clause or phrase of this ordinance
is for any reason held to be unconstitutional, void or invalid, the validity of
the remaining portions of this ordinance shall not be affected thereby, it
being the intent of the City Council in adopting this ordinance that no portion
hereafter or provision or regulation contained herein shall become inoperative
or fail by reason of any unconstitutionality or invalidity of any section, sub-
section, sentence, clause, phrase, portion, provision or regulation of this
ordinance.
SECTION 4.
Any person, firm, or corporation who violates, disobeys, omits, neglects
or refuses to comply with this ordinance, or who resists the enforcement of any
of the provisions thereof, shall be fined not less than Five Dollars 45.00)
nor more than Two Hundred Dollars ($200.00) for such offense. Each day that
a violation is permitted to exist shall constitute a separate offense.
SECTION 5.
The zoning regulations and districts, as herein established, have been
made in accordance with a comprehensive plan for the purpose of promoting health,
safety, morals and the general welfare of the community. They have been designed
to lessen congestion in the streets; to secure safety from fire, panic and other
dangers; to provide adequate light and air; to prevent the overcrowding of land;
and avoid undue concentration of population; to facilitate the adequate provision
of transportation, water, sewerage, parks and other public requirements. They
have been made with reasonable consideration, among other things, of the character
of the district and its peculiar suitability for the particular uses and with a
view of conserving the value of buildings and encouraging the most appropriate
use of land through the community.
SECTION 6.
This ordinance shall take effect and shall be in full force and effect
from and after its passage and publication as provided by law.
