Date Received: 2/15/2023 Time Received: 1:29 p.m. Permit No.: SWFMA-22-0093 City Secretary No.: 54365-A1 AMENDMENT TO CITY SECRETARY CONTRACT NO. 54365 STORMWATER FACILITY MAINTENANCE AGREEMENT This AMENDMENT TO CITY SECRETARY CONTRACT NO. 54365, STORMWATER FACILITY MAINTENANCE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized City Manager or duly designated Assistant City Manager, hereinafter referred to as the "City", and Riverside Storage Fort Worth, LLC "Landowner", acting herein by and through its duly authorized representative Mike Morely as Manager. RECITALS WHEREAS, the City of Fort Worth ("City") and Sundial Office Park, LLC ("Previous Landowner"), made and entered into City Secretary Contract No. 54365 (the "Agreement") to authorize the use of on -site stormwater management facilities (the "Facility") to be constructed and maintained on a portion of Landowner's property; and WHEREAS, the Agreement was recorded with the property records of the Tarrant County as Document No. D220218071 which is one and the same as City Secretary Contract 54365. WHEREAS, the Previous Landowner has subsequently sold, transferred, or conveyed the real property more particularly described in the Agreement to Riverside Storage Fort Worth, LLC according to the deed recorded in Document No. D220218071, Deed Records, Tarrant County, Texas hereinafter called the "Property", who has requested the City to consider certain location and design changes; and WHEREAS, the Agreement contains exhibit(s) "A" and "B" that depicts the location and design specifications of the Facility; and Revised 03/01/2022 BN OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX Page 1 of 4 WHEREAS, it advisable to execute this Amendment to the Agreement to revise exhibit(s) "A" and "B" in the Agreement to depict location and design changes to the original agreement; and NOW THEREFORE, City and Landowner, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. Exhibit A is hereby replaced with Exhibit A-1 attached hereto and incorporated herein to the Agreement, consisting of a revised location description of the Facility. 2. Exhibit B is hereby replaced with Exhibit B-1 attached hereto and incorporated herein to the Agreement, consisting of revised design specifications of the Facility. 3. This Amendment shall be filed with the City Secretary as an amendment to the Agreement and also recorded among the land records of Tarrant County, Texas, and shall constitute a covenant running with the land, and shall be binding on the Landowner, its administrators, executors, assigns, heirs and any other successors in interests, including any property owners association. 4. Genergl M-aintenance Procedures The structural and functional integrity of the Facility shall be maintained at all times by removing and preventing drainage interference, obstructions, blockages, or other adverse effects into, through, or out of the system. Periodic silt removal shall occur when standing water conditions occur or the pond's storage volume is reduced by more than 10%. Silt shall be removed and the pond/basin returned to original lines and grades shown on the approved engineering plans. In addition, corrective measures are required any time a basin does not drain completely within 72 hours of cessation of inflow. NO STANDING WATER IS ALLOWED in basins designed for dry detention purposes. Accumulated litter, sediment, and debris shall be removed every 6 months or as necessary to maintain proper operation of the basin. Disposal shall be in accordance with federal, state and local regulations. Detention facilities shall be mowed monthly between the months of April and October or anytime vegetation exceeds 12-inches in height. To prevent debris from entering and clogging the downstream storm sewer system a wire mesh screen or similar screening device shall be installed over the outlet until final acceptance. 4. PREVENTIVE MAINTENANCE/INSPECTION Visual inspections of all components will be conducted every 6 months. A log shall be kept of maintenance actions, and inspections. The log should document the condition of the detention system's primary components, mowing, and silt, litter and debris removal dates. Document aeration of the basin bottoms and replanting to prevent the sealing of the basin bottom. Written maintenance and repair records shall be maintained by the party or parties signing the attached Agreement and shall be provided to the City upon request.
