HomeMy WebLinkAboutOrdinance 6145 d ORDINANCE NO. �''� AN ORDINANCE MAKING CERTAIN FINDINGS: PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY' CONSISTING OF 554 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDI- NANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hail of Fort Worth, Texas, on the 28th day of July, 1969, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 15th day of July, 1969, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 198.222 square miles on January 1, 1969, and WHEREAS, the hereinafter described territory lies within the extraterri- torial jurisdeiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 554 acres; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: j SECTION 1. The following described land and territory lying adjacent to and adjoin- ing the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: BEING portions of the Hiram Little Survey, Abstract No. 930 and the Abner Lee Survey, Abstract No. 931 , situated about 11 miles south from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a point for corner in a present City of Fort Worth city limit line, as said city limit line was established by Ordinance No. 6116, adopted on second and final reading on July 14, 1969; said point for corner being the intersection of the south right-of-way line of State FM Road 1187 with the west right-of-way line of Everman Forest-Hill Road (County Road No. 1004) produced south; THENCE east along and with the south right-of-way line of State FM Road 1187 approximately 700 feet to a point for corner at its intersection with the west right-of-way line of Everman Forest-Hill Road (County Road No. 1004); THENCE, along and with the westerly right-of-way line of Everman Forest-Hill Road: Southerly approximately 2100 feet, and Westerly approximately 450 feet, and Southwesterly approximately 900 feet, and Southerly approximately 1400 feet, and Westerly approximately 1500 feet, and Southerly approximately 500 feet, and Southwesterly approximately 1100 feet, and Southerly approximately 1300 feet to a point for corner at the intersec- tion of the westerly right-of-way line of the Everman Forest-Hill Road (County Road No. 1004) with the north right-of-way line of Burleson Cardinal Retta Road (County Road No. 1664): THENCE West, along and with the North right-of-way line of Burleson Cardinal Retta Road (County Road No. 1064) approximately 3300 feet to a point for corner at its intersection with the easterly line of the Texas Electric Service Company easement heretofore referred to, said point of intersection also being in the City of Fort Worth city limit line established by Ordinance No. 6116 on July 14, 1969; THENCE, along and with the present City of Fort Worth city limit line: NORTHEASTERLY along the easterly line of the Texas Electric Service Company easement approximately 7500 feet to a point for corner at its intersection with the south right-of-way line of State FM Road 1187, and EAST along and with the south right-of-way line of State FM Road 1187 approximately 3100 feet to the place of beginning and containing approximately 554 acres of land (0.866 square miles). -2- SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of taxes levied by the City of Fort Worth, Texas, and the inhab- itants therof shall be entitled to all of the rights and preibileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional , by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. S, Highway 81 South, the City Council requested that the Plan Commission make a' recommendation on the annexation of the area which includes the Oak Grove. Airport. Ilse City Plan Commission has reviewed the economic potential of the area, future growth patterns, utility service needs, and recommends that the City Council annex approximately 554 acres of land adjacent to the Oak Grove Airport. The proposed annexation is immediately contiguous to the property annexed by the City Council by Ordinance Number 6116 (U. S. Highway 81 South). Nature of Existing Ddvelo: ment The area recommended for annexation contains the Oak Grove Airport and the M. H. Spines Enterprises, Inc. , manufacturer of aircraft equipment. In addition, the area includes one filling station fronting on State FM Highway 1187.. The remainder of the land is largely in agricultural and grazing use. Sanit $ewer Service In accordance with the Master Sewage Plan developed for the area, sanitary sewer service will be provided by the extension of the Village Creek Collector Sewer. The area lies within a watershed draining into Fort Worth which will permit the extension of sanitary ,sewer service. On an interim basis, sanitary sewage might be provided to the area by construction of a combination lift station and force mains which would discharge into the existing Village Creek Collector System or a small package sewage treatment plant near Deer Creek. Waste Dis, osal Fire and Police Services Waste disposal service can be provided by private haulers as all of the development currently is industrial or commercial or city aervice can be extended to the area as needed. Fire protection would be extended from the new station proposed near tile intersection of Oak Grove Road and Everman Road and the existing Felix Street Station .. Police protection can be extended to this area with minor realignment of beat coverage. The City Attorney of ;Post Worth has filed suit against Burleson to nullify its actions but the case has not come before the court. Recommendation It is recommended that the City Council, adopt a resolution setting July 78, 1969, at 9 :30 a.m. as the time for public hearing on the contemplated annex- ation and authorizing and directing the City Secretary to publish the notices required by State Statute.
