HomeMy WebLinkAboutOrdinance 26010-02-2023 ORDINANCE NO. 26010-02-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECT OTHER FUND, SUBJECT TO RECEIPT OF THE GRANT,IN THE AMOUNT OF$110,460.00,FOR THE PURPOSE OF FUNDING THE HOFFMAN FOUNDATION TREE PLANTING PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Capital Project Other Fund subject to receipt of the grant, in the amount of$110,460.00, for the purpose of funding the Hoffman Foundation tree planting project. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the acceptance of a grant in the amount of$110,460.00 from the Marilyn Brachman Hoffman Foundation for the Hoffman Foundation tree planting project; 2. Amend the Fiscal Years 2023-2027 Capital Improvement Program;and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Project Other Fund subject to receipt of the grant,in the amount of$110,460.00,for the purpose of funding the Hoffman Foundation tree planting project. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to accept a $110,460.00 grant from the Marilyn Brachman Hoffman Foundation into the Grants Capital Project Other Fund for the Hoffman Foundation tree planting project which will provide for the establishment of 56 trees at four park locations. The Park& Recreation Department (PARD)was approached by the Marilyn Brachman Hoffman Foundation (Foundation) in July of 2021 regarding a proposal to establish trees in socioeconomically disadvantaged neighborhoods and at nearby roadways/bus stops.As funds had not been identified for these improvements,the Foundation generously volunteered a grant for$20,000.00 to$25,000.00 and requested a list of areas for the Foundation to select.A list of four locations were provided to the Foundation Board for consideration. On November 5,2021,the PARD received notice that the Foundation Board had approved a grant in the amount of$74,100.00 to establish trees at all four locations.The funds provided covered the value of materials and services, including the cost of the trees, delivery, installation,and two years of watering. The 39 trees were planted at the following parks: Delga Park(7 trees), Rosemont Park(6 trees), Rosedale Plaza Park(13 trees), and Calmont Park(13 trees).All the trees were planted in Fiscal Year(FY)2022.There was minor tree mortality following the summer of 2022,and all missing or dead trees will be replaced during FY2023. On April 4, 2022, as a result of the Foundation's satisfaction with the initial plantings,the Foundation once again approached the PARD with a generous proposal to expand the program and plant additional trees under a separate furnishing of grant funds.The PARD submitted four additional parks to the Foundation for consideration. On May 3, 2022,the PARD received notification that the Foundation Board had approved a grant in the amount of$110,460.00 to plant and establish 56 trees at four park locations.The funds provided will cover the value of materials and services, including the cost of the trees,delivery, installation, and two years of irrigation via the PARD water truck.The 56 trees will be planted at the following parks: Bonnie Brae Park(6 trees), Eastover Park(20 trees), Hillside Paris(22 trees),and Seminary Hills Park(8 trees).All of the trees will be planted in FY2023. This project will have no impact on the PARD's annual operating budget when completed. Funding for this project was not included in the FY2023-2027 Capital Improvement Program.The action in this M&C will amend the FY2023- 2027 Capital Improvement Program in accordance with Ordinance 25073-09-2022. On September 28, 2022 the Park& Recreation Advisory Board voted to recommend that the City Council accept the grant from the Marilyn Brachman Hoffman Foundation. The four park locations are located in COUNCIL DISTRICTS 4,5,8,and 9/Future CD 11,5,8,and 9. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current capital budget, as appropriated, in the Grants Capital Project Other Fund for the Hoffman Foundation Grant project.The Park&Recreation Department(and Financial Management Services)is responsible for the collection and deposit of funds due to the City. Prior to any expense being incurred,the Park& Recreation Department will also have the responsibility to validate the availability of funds. This is an advance grant.
