HomeMy WebLinkAboutOrdinance 17192-09-2006Ordinance No. 17192-09-2006 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $814,622 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT W1TH CONATSER CONSTRUCTION, TX, LP, FOR SANITARY SEWER REHABILITATION CONTRACT LXVIII (68), UNlT 1; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORf71NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 20052006 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $814,622 from available funds for the purpose of executing a contract with Conatser Construction, TX, LP, for Sanitary Sewer Rehabilitation Contact LXVII I (68), Unit 1. SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shad in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shalt be cumulative of Ordinance No. 16582 and a!I other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize fhe transfer of $817,622.00 from the Water and Sewer Operating 1=und to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in fhe Sewer Capital Projects f=und in the amount of $814,622.00 from available funds; and 3. Authorize the City Manager to execute a contract with Conatser Construction, TX, LP , in the amount of $718,772.0© for Sanitary Sewer Rehabilitation Contract LXVIIi (68}, Unit 1. ©ISCUSS~oN: On November 12, 2002, (M&C C-19346} the City Council authorized an engineering agreement with Carter & Burgess, Inc., for Sanitary Sewer Rehabilitation Contract LXVIII. The agreement provided for the preparation of plans and specifications for the replacement of the following severely deteriorated sanitary sewer mains and laterals: M-1541L-25091E-2499, L-3122, L-27091LW27891L-4143, L-4565, L-3586, L-2781 and L-2140. In order to alleviate repeated complaints of sanitary sewer back-up received from residents adjacent to sewer lateral L-3122, it is necessary to relocate the lateral (via this project), from an inaccessible location in the backyards of private property into public street right-nf-way on Oid Benbrook Road (Mary's Creek Rnad to Davenport Avenue). The remaining main and laterals of Sanitary Sewer Rehabilitation contract LXVIII (68}, will be advertised far bid at future dates. This project was advertised for bid nn June 1 and 8, 2006. On June 29, 2006, the fallowing bids were received: Bidder Amount Conatser Construction TX, LP $ 718,772.00 Cleburne Utility Canstruction, lnc. $ 814,172.DD Wiliam J. Schultz, Inc. dlbla Circle $ 890,906.00 Jackson Construction, Ltd. $1,360,179.00 Time of Carnpletian 120 Calendar Days Lognarne: 3QLXVftZ{68)CON Page L of 2 In addition to the contract cost, $74,287.00 is included far survey, inspection and other construction related tasks and $21,563 is provided for project contingencies. MIWE3E - Canatser Construction TX, LP is in compliance with the City's M/WBE Ordinance by committing to 20 percent MNVBE participation. The City's goal an this project is 19 percent. This project is located in COUNCIL DISTRICT 3, Mapsca 73Z and 87D. FISCAL.
