Home My WebLink AboutOrdinance 20802-07-2013 Ordinance No. 20802-07-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF$158,719.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF WATER AND SANITARY SEWER IMPROVEMENTS ON BELLAIRE SOUTH DRIVE AND BELLAIRE WEST DRIVE;PROVIDING FOR A SEVERABILITY CLAUSE;MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$158,719.00, from available funds, for the purpose of water and sanitary sewer improvements on Bellaire South Drive and Bellaire West Drive. SECTION 2. T11at should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of$259,815.00 from the Water and Sewer Operating Fund in the amounts of $158,719.00 to the Water Capital Projects Fund and $101,096.00 to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinances increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$1 58,719.00 and in the Sewer Capital Projects Fund in the amount of$101,096.00; and 3. Authorize the execution of Engineering Agreement with Teague Nall & Perkins, Inc., in the amount of $239,815.00 for Bellaire Drive Water and Sanitary Sewer Improvements. DISCUSSION: This project consists of the preparations of plans and specifications for the replacement of the deteriorated water and sanitary sewer mains along Bellaire South Drive (Overton Park East Drive to Bellaire West Drive) and Bellaire West Drive (Bellaire South Drive to Westcliff North Road). Teague Nall & Perkins, Inc., proposes to perform the design work for a lump sum fee in the amount of $239,815.00. Staff considers this fee to be fair and reasonable for the scope of services proposed. M/WBE Office: Teague Nall & Perkins, Inc., is in compliance with the City's BDE Ordinance by committing to 22 percent SBE participation on this project. The City's SBE goal on this project is 20 percent. In addition to the contract amount, $20,000.00 (water: $12,000,00 and sewer: $8,000.00) is required for project management, real property acquisition and utility coordination. The project is located in COUNCIL DISTRICT 9, Mapsco 75Y and 75Z.
