AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE PUBLIC EVENTS CAPITAL FUND BY
DECREASING THE UNSPECIFIED PROJECT (CITY PROJECT NO. UNSPEC)
BY $625,000.00 AND INCREASING THE WRMC LOBBY AND CONCOURSE
RENOVATION PROJECT (CITY PROJECT 104227) BY THE SAME AMOUNT;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the budget of the City of Fort Worth for Fiscal Year 2022-2023, as enacted by Ordinance 25773-09-
2022, as amended, is hereby further amended to adjust estimated receipts and appropriations in the Public
Events Capital Fund by decreasing the Unspecified Project (City Project No. Unspec) by $625,000.00, and
increasing the WRMC Lobby and Concourse Renovation Project (City Project No.104227) by the same
amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair
the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

and Concourse Capital Improvements at the Will Rogers Memorial Center,Allocate Use of an Additional$625,000.00 in Available Public Events
Capital Fund Dollars to the Lobby and Concourse Project,and Adopt Appropriation Ordinances
RECOMMENDATION:
It is recommended that the City Council:
1. Reallocate the use of$5,950,000.00 of American Rescue Plan Act State and Local Fiscal Recovery Funds from the WRMC Air Handler
project to the WRMC Lobby and Concourse Renovation project;
2. Adopt the attached ordinance adjusting appropriations in the Grants Capital Projects Federal Funds by decreasing appropriations in
the WRMC Air Handler Project(City Project No. 104226)in the amount of$5,950,000.00 and increasing appropriations in the WRMC Lobby
and Concourse Renovation project(City Project No.104227)by the same amount;and
3. Adopt the attached ordinance adjusting estimated receipts and appropriations in the Public Events Capital Fund by reducing the
Unspecified Project(City Project No. Unspect)by$625,000.00 and increasing the WRMC Lobby and Concourse Renovation project(City
Project 104227)by the same amount.
DISCUSSION:
This Mayor and Council Communication(M&C)seeks City Council approval to reallocate American Rescue Plan Act(ARPA)State and Local
Fiscal Recovery Funds(SLFRF)that were previously approved for use at the Will Rogers Memorial Center to the coliseum concourse and lobby
renovation project at the facility and to supplement that project's funding by appropriating additional available funds in the Public Events Capital
Fund.
M&C 22-0789 was approved by the City Council on September 27,2022 and allocated$7,875,000.00 in ARPA SLFRF for capital projects at
the Will Rogers Memorial Center Coliseum. The ARPA Revenue Recovery funds were to be divided between a renovation of the lobby and
concourse($1.925M)and the replacement of air handling units($5.95M)at the coliseum.The cost estimate for these two projects combined
now totals$17.9M
In light of these cost increases,and after consulting with the venue's customers,the Public Events Department(PED) is recommending the
entirety of the $7,875,000.00 in ARPA funding previously designated for the coliseum be invested specifically in the customer-facing
improvements for the lobby and concourse, with the needed replacement of air handling units to be addressed in a future PED Capital
Improvement Program. The total estimated costs for the revised coliseum lobby and concourse project is$8,500,00.00 and is proposed to take
place in the following priority order under the umbrella of a single project:
• Renovation of the WRMC Coliseum Concourse and Restrooms(estimated at$6.2M)
• Renovation of the WRMC Coliseum Backstage Club(estimated at$1.3M)
• Renovation of the WRMC Coliseum Lobby(estimated at$1.OM)
M&C 22-0984,approved by City Council on November 29, 2022,increased estimated appropriations and receipts in the Public Events Capital
Fund Unspecified Project by$1,000,000.00 for the purpose of funding future shortfalls in grant projects where scope adjustments or delayed
project implementation due to income loss during the pandemic resulted in increased costs. This M&C reallocates $625,000.00 of that
$1,000,000.00 to the shortfall for the WRMC Lobby and Concourse Renovation project
Adoption of the attached ordinance adjusts appropriations as between projects but does not increase total appropriations in either fund.
Funding is available in the capital projects of the Public Events Capital Fund as approved in connection with Ordinance 25851-1 1-2022 and the
Grants Cap Projects Federal Fund as approved in connection with Ordinance 25776-09-2022.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Public Events Capital Fund UNSPEC project and Grants Cap Projects
Federal Fund WRMC Coliseum Air Handle Repl project,and upon approval of the above recommendations and adoption of the attached
appropriation ordinances,funds will be available in the Public Events Capital and Grants Cap Projects Federal Funds WRMC Lobby&Concourse
Renov project. Prior to an expenditure being incurred,the Public Events Department has the responsibility of verifying the availability of funds.
