PROJECTS FUND IN THE AMOUNT OF $27,114.30 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $37,402.13 PROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH SLATER ENGINEERING, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT 2004 CIF, CONTRACT 45, PROJECT 00446; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFIECTIVE BATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $27,114.30 and the Sewer Capital Projects Fund in the amount of $37,402.13 from available funds for the purpose of funding an engineering agreement with Slater Engineering, loc. far Pavement Reconstruction and Water and Sanitary Sewer Main Replacement, 2004 CIF, Contract 45, Project 00446. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. I# is recommended that the City Council: 1. Authorize the transfer of $64,516.43 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $27,114.30 and Sewer Capital Projects Fund in the amount of $37,402.13; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $27,114.30 and the Sewer Capita! Projects Fund in the amount of $37,402.13, from available funds; and 3. Authorize the City Manager to execute an engineering agreement with Slater Engineering Inc., in the amount of $117,796.00 for pavement reconstruction and water and sanitary sewer main replacement on Spindletree Lane (Buttonwood Drive to Pepperbush Drive). DISCUSSION: The 2004 Capital Improvement Program {C!P) includes funds for pavement reconstruction an Spindletree Lane {Buttonwood Drive to Pepperbush Drive). This project consists of the preparation of plans and specifications for the replacement of water and sanitary sewer mains and pavement reconstruction on the above identified streets. Slater Engineering, Inc., proposes to pertarm the necessary design work fora lump sum fee of $117,796.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount $14,581.23 (water: $3,534.30; sewer: $3,206.13; and streets: $7,840.80) is required for project management by the Engineering Department. Slater Engineering, Inc., is in compliance with the City's MIIIVBE Ordinance by committing to 18 percent MNVBE participation. The Gity's goal an the project is 16 percent.
