An Appropriation Request for $ 138,000.00 has been approved for this pro- ject from Future Bond Sales. Section I I of the ordinance awaiardi rlg the contract states that the appropriation Is made from available funds. 1t is the opinion of the City Legal Department that an appropriation from future Bond Sales will not support this section of the ordinance. It is recommended that the City Council adopt are ordinance awarding the ,contract to Texas Bitulithic Company on the basis of their low bid in the amount of $179,269. 12, without the the services of a fiscal agent, and that an Appropriation Request for $ 100,000 be approved for the city's portion of the cost. It is further recommended that this amount be trans- ferred from Berri/ Street - Tarrant Road, 1959 Allocation, Project No. 94-83-5, to be returned to project (94-83-5) after 11960 Bond Sale.
