AN ORDINANCE APPROVING THE REPORT OF THE PUBLIC
WORK DEPARTMENT: AWARDING THE CONTRACT OF THE
IMPROVEMENTS OF VARIOUS STREETS AT SIX (6) LOCAL
TIONS IN THE CITY OF FORT WORTH, TEXAS, AND AUTH-
ORIZED ITS EXECUTION: AND DIRECTING THE CITY
ENGINEER TO PREPARE ESTIMATES
WHEREAS, by Ordinance Nos. 4219 thru 4223 passed and approved by the City
Council of the City of Fort Worth, the City Council determined the necessity for
and ordered the improvement of a portion of the following streets, to-wit:
UNIT NO. 1, BRYAN STREET: from the south line of Ripy Street
to the north line of Butler Street,
UNIT NO. 2, BRYAN STREET: from the north line of Butler Street
to the north line of Dickson Street,
UNIT NO. 3A, SOUTH GROVE: from the north line of Ripy Street
to the south line of Shaw Street,
UNIT NO. 3B, from the south line of Shaw Street
to the north line of Bowie Street,
UNIT NO. 4, TRINITY STREET: from the southerly line of West
Freeway (also known as West Rosedale)
to the southerly line of Rutledge
Street,
UNIT NO. 5, MONTGOMERY ST.: from the south line of Seventh Street
to the north line of Camp Bowie,
UNIT NO. 6, ELLIS AVENUE: from the Northwest 23rd Street to
Northwest 25th Street.
WHEREAS, subsequent to the passage and approval of said Ordinance, Plans
and Specifications for said improvements were submitted by the Public Works Director
and said Plans and Specifications were approved and adopted by the City Council;
and,
WHEREAS, Notice to Bidders was given as required by the City Charter; and,
WHEREAS, the bid of Texas Bitulithic Construction Company was found to be
the lowest and best bid for the making and construction of said improvements, to-
wit: Excavation of present streets, construction of various types of pavement with
combined curb and gutter and necessary appurtenances, all as provided by said Plans
and Specifications;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXASt
SECTION I
That the work of making and constructing such improvements and contracts
therefore is hereby awarded to Texas Bitulithic Construction Company, at and for
the prices stated in the proposal of the said Company and as reported and recommended
by the Public Works Department. The City Manager and City Secretary are hereby
directed to execute the said contract in the name of the City of Fort Worth, Texas,
and to impress the corporate seal of the City thereon, the said contract embracing
therein, among other things, the prices for the work.
SECTION II
That to provide for the payment of the indebtedness incurred by the City
of Fort Worth by said Contract, there is hereby appropriated out of available
funds, which have been set aside for said purpose an amount sufficient to pay
said indebtedness so incurred.
SECTION in
That the Public Works Director of the City of Fort Worth be, and he is
hereby ordered and directed to file with the City Council estimates of the cost
of such improvements in accordance with the terms of the powers and provisions of
Chapter 106 of the Acts of the First called session of the Fortieth Legislature
of the State of Texas, now shown as Article 1105b of Vernon's Civil Statutes of
the State of Texas, Annotated, which law has been adopted as an amendment to and
made a part of the Charter of the City of Fort Worth.

Mrs, McKnight and Gentlemen:
On January S, 1960, bids were received for the paving of Bryan Street
from Ripy Street to Butler Street; Bryan Street from Butler Street to
Oickson Street; South Grove Street from Ripy Street to Bowie Street;
Trinity Street from Fast-West Freeway to Rutledge Street; Montgomery
Street from West Seventh Street to Camp Bowie Boulevard; and Ellis Ave.
from Northwest 23rd Street to Northwest lath Street, "Assessment Paving
of Various Streets at Six (6) Locations," in accordance with Ordinance
No. 4224. The specifications provided for alternate types of pavement
which are;

The bpecificetions called for bids on two basis: Bid No. I and
Bid No. 2 on a cash basis with a fiscal agent performing the assessment
work, preparing rolls and accepting assessment certificates.

On the basis of the lowest bid submitted in the amount of 179,269. 12 by
Texas Bitulithic Co., the City's portion of the coast will be $84:,081.20
and the-property owner's cost will be $89, 127.92 leaving the railroad's
assessment at $6,060.00..
An Appropriation Request for $ 138,000.00 has been approved for this pro-
ject from Future Bond Sales. Section I I of the ordinance awaiardi rlg the
contract states that the appropriation Is made from available funds. 1t
is the opinion of the City Legal Department that an appropriation from
future Bond Sales will not support this section of the ordinance.
It is recommended that the City Council adopt are ordinance awarding the
,contract to Texas Bitulithic Company on the basis of their low bid in the
amount of $179,269. 12, without the the services of a fiscal agent, and
that an Appropriation Request for $ 100,000 be approved for the city's
portion of the cost. It is further recommended that this amount be trans-
ferred from Berri/ Street - Tarrant Road, 1959 Allocation, Project No.
94-83-5, to be returned to project (94-83-5) after 11960 Bond Sale.
