AN ORDINANCE AMENDING SECTIONS 1 AND 2 OF ORDINANCE 110. 4183, WHICH ORDINANCE AMENDED SECTIONS VI AND VII OF, ORDINANCE NO. 3701, WHICH IS AN ORDINANCE PRESCRIBING RATES CHARGED CON- SUMMS OF WATER SUPPLIED BY THE FORT WORTH CITY WATER WORKS, CONNECTION CHARGES AND SANITARY SEWERAGE SERVICE CHARGES, BY PROVIDING FOR AN INCREASE IN THE RATES THEREOF; REPEALING ALL ORDINANCES IN CONFLICT HER17,11TH AND MAKING THIS ORDIRXTCE CUMULATIVE OF ALL OTHER PROVISIONS OF ORDINANCES Nos. 4183 AND 3701 AND ALL OTHER ORDINANCES ON THE SAME SUBJECT MATTER EXCEPT WHERE SAME CONFLICT HEREWITH; PROVIDING A PENALTY FOR THE VIOLATION HEREOF OF A FINE NOT LESS THAN TWENTY-FIVE DOL- LARS (25-00) NOR MORE THAN ONE HUNDRED DOLLARS ($100.00), PRESCRIBING A SAVINGS CLAUSE; PROVIDING THAT ALL THE PROVI- SIONS OF THIS ORDINANCE SHALL BE DEEMED TO BE INCORPORATED IN EVERY CONTRACT BETWEEN THE CITY OF FORT WORTH WATER WORKS AND EACH AND EVERY WATER AND/OR SANITARY SEWERAGE SERVICE CUSTOM; AND NAMING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, at great expense, has built or caused to be built, a sanitary sewerage system, including interceptor or collector lines, mains, sub-mains, laterals, pump stations, treatment plants and other necessary appurtenances and facilities for the purpose of collecting sewage and acceptable industrial waste and transporting same away from the premises to places of treatment and disposal; and, WHEREAS, said City maintains said lines, plants and facilities as a sanitary sewerage system and component part of the Fort Worth City lister Works; and, WHEREAS, funds sufficient for the cost, maintenance and operation of the water and sewerage system are not available from operating reve- nues of the City; and, WHEREAS, the City Council, in the exercise of the discretion reposed in it by law, in order to promote the public welfare, health, safety and convenience, has decided that it is necessary, in order to provide for payment of the cost and the expense of the maintenance, operation and re- pair of such property, to levy and collect increased charges for the use of such water and sewerage lines and facilities; and, WHEREAS, the succeeding provisions of this ordinance, after investi- gation by the City Council of the City of Fort Worth, have been deemed to be reasonable charges, rules and regulations for the conduct of such busi- ness, and for the payment of the cost and expense of maintenance, opera- tion and repair of the water and sewerage system of the City of Fort Worth, and for the furnishing of water and sewerage service; NOW, THERE- FORE, BE IT ORDAI11ED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 1 of Ordinance No. 4183 (formerly Section VT of Ordi- nance No. 3701, as amended) be, and the same is, hereby amended so that hereafter the same shall read and be as follows: Section 1. The following schedules of rates per month, or fraction thereof, shall be the charges to all persons, as herein de- fined, for furnishing water to -water consumers and/or for rendering sanitary sewerage service to premises located with- in the corporate limits of the City of Fort Worth: SCHEDULE A. For sanitary sewerage service customers whose water is not measured by a meter, a flat, rate of One and 25'/100 Dollars 01.25) per month shall be charged for each dwelling unit to which service is provided directly or indirectly. For each business, commercial or industrial unit to which sanitary sewerage service is furnished directly or indirectly and whose use of water is not measured by a meter, the Director of the Fort Worth City Water Tbrks is authorized to apply Schedule C, based upon an estimated water use to determine such monthly charge. The minimum monthly charge for each such customer shall be One and 75/100 Dollars ($1.75). -3- The monthly charge to be made for each industrial waste producer for rendering service in connection with the treatment of industrial waste shall be based on the Five-Day Biochemical Oxygen Demand content of such waste. The relative strength or base factor of industrial waste introduced into the sanitary sewerage system shall be computed using the Five-Day Biochemical Oxygen Demand content for domestic sewage of 300 parts per million by weight for comparison. The billing factor is here- by determined to be the Five-Day Biochemical Oxygen Demand con- tent of the industrial waste as expressed in parts per million by weight divided by the figure 300. The monthly sewerage service charge for an industrial waste producer shall be com- puted using the applicable rate schedule above multiplied by such billing factor. The Director of Public Works or City Lngineer is hereby authorized to determine or cause to be de- termined the Biochemical Oxygen Demand content of industrial waste not less than once each year. That Section 2 of Ordinance No. 4183 (formerly Section VII of Ordi- nance 110. 3701, as amended) bey and the same is, hereby amended so that hereafter the same shall read and be as follows: Section 2. (a) A minimum charge per month, or fraction thereof, shall be made for each connection with the water mains and/or sever mains of the City I-rater 1117orks. Such minimum charges do not apply for connections to unmetered automatic sprinkler systems in- stalled and used for fire protection only, for which the monthly charge shall be One and no/100 Dollars ($1.00) per one inch (l") of diameter of the senTice connection. All fire protec- tion systems provided -with outlets other than standard closed sprinkler heads must be provided with meters before connecting with water mains of the City of Fort Z-forth. Charges for water furnished through such meters shall be made at rates in effect. -4- The charge for replacing a one inch (1") or one and one- half inch (1-1�2") meter with a smaller meter shrill be Ten and no'100 Dollars 010.00), and the charge for replacing a two inch (2") meter with a smaller meter shall be Fifteen and no'100 Dollars ($15-00). The charge for replacing a meter smaller than one and one-half inches (1-1/2") with a one inch (1") or one and one-half inch (1-112") meter sioall be Twenty and no'100 100 Dollars (20.00). The charge for replacing a meter smaller than a two inch (2") meter with a two Lach (2") me-ter shall be Thirty and noi,lx Dollars .00'. in -10 case will a meter be installed of a size larger than tLe service line to the main. Only one 5/8 x 3W' or 3,14" meter shall be attached to and served by a, 3!4" tap. Not more taan two 3'4" or. one 1" meter shall be attached to and served by a 1" tap. Not more than one 1-1'2" or four 3'4" or three 1" meters shall be at- tached to and seared by a 1-l!2" tap. Not more than one 2"9 four 1" meters, or eight 3/4" me'cers sAall be atta-citied to and served by a 2" tap. (b) In P11 cases where more than one living or business unit is supplied water through one meter, not less than a minimum charge for such water snall be made for each living unit or business unit supplied through such me-ter, and all additional water service charges above the minimum for each such unit shall be based upon the quantity of water passing through the meter or meters divided by the number of units and charged for as set forth in the applicable rate schedules above. (c) In a.11 cases where more than one living or business unit is supplied water through a water meter or meters and a sanitary sewerage service charge is made., in coinaection there- with, at least a minimum cha.2ge for such service shall be made for each urit supplied water through such meter or meters and all additional sanitary sewerage service charges above the mini- mum for each -unit shall be based upon the quantity of water passing through such meter or meters, regar,.Ues., of source, di- vided by the number of units i.i�id charged for as set forth in the applicable rate schedules above, (d) A charge shall be made by the City Vater V,7orks for each tapping of the water mains for a connection, said charge to be determined by the size of the connection and the character of the surface of the street in which the connection is to be located. SECTIOII 3. This ordinance shall repeal every prior ordinance in conflict here- with, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of Ordinances 1^Ios. 4183 and 3701 and all other ordinances on the same subject matter not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTIOx 4. A violation of any of the above rules and regulations of the City Water �,orks as set out herein, or a doing or causing to be done by any person or persons, firm or association, of any of the things or acts forbidden or made unlawful in any of such rules and regulations, shall be deemed to constitute a violation under the terms of this ordinance and an offense, and shall be punishable as such; and for each and every violation of the terms of this ordinance, the person, firm, association or corporation shall, upon conviction thereof in the Corporation Court, be fined not less than Twenty-five Dollars (:)25.00) nor more than One Hundred Dollars (p100.00), and each violation and each day there is a failure to comply with the terms of this ordinance shall constitute a separate offense. SECTION 5. If any section, part of a section or provision of any section of this ordinance shall be held to be void, ineffective or unconstitu- tional by a court of competent jurisdiction, the holding of such sec- tion, part of a section or provision of any section to be void, iiZef- fective or unconstitutional for any cause whatsoever shall in no way ",fe°t the validity of the remaining sections and pro-r?_sions of this ordinance, which shall remain in full force and effect. The City -6- Council mould not have passed any sections, parts of sections or pro- visions of any section of this ordinance that were unconstitutional, void or ineffective if they had known thaO they were unconstitutional, void or ineffective at the time of adopting this ordinance. SECTiaa 6. All of the provisions of this ordinance shall be deemed to be in- corporated in every contract between the City of Fort Wrth and its water and/or sanitary sewerage service customers, and eats customer or consumer shall be charged with knowledge of the provisions of this ordinance and, by applying for and accepting water or sanitary sewerage service from the City of Fort Tbrth, to have assented to the provisions thereof.
