HomeMy WebLinkAboutContract 57475-A2AMENDMENT NO. 2 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES FORT WORTH HUB AND AQUATICS CENTER STATE OF TEXAS CITY SECRETARY CONTRACT NO. 57475-A2 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Harrison Korn berg Architects, LLC (Consultant) made and entered into City Secretary Contract No. 57475 (The Contract) which was authorized administratively, the 26th day of April, 2022, for Programming Services for the HUB Community and Aquatics Centers; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for additional design services for Construction Documents and Administration Services for the HUB Community and Aquatics Centers. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional design services for the Construction Documents and Administration Services for the HUB Community and Aquatics Centers. The cost of this additional service is $2,026,431.00 plus $81,000.00 in reimbursable expenses. The scope of services is described more fully in Harrison Korn berg's Letter dated December 20, 2022 (Revision 1), subject: "Proposal for Architectural / Engineering Services", Project: Fort Worth HUB & Aquatics Center, Address: To be located at the former J. A. Cavile Place Apartments near East Rosedale and Liberty Streets (1500 block of Liberty Street). Attached. 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "A". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "A". However, the total fee paid by the City shall not exceed a total of $2,199,969.00 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." The new aquatics center is to include an exterior 8-lane, 25-yard lap pool, separate exterior multi -purpose leisure pool of approximately 3,500 square feet of water surface area, and support space(s). We understand the project also includes approximately 9,000 square feet for Child Care Associates. The square footage for Child Care Associates will be in addition to the community center and aquatics center square footage. The project is being funded by Fort Worth Housing Solutions, American Rescue Plan Act (ARPA), and through the 2022 Fort Worth Bond. The total project budget is $31,577,500 of which approximately 70% will be allocated for the Construction Cost Limitation (CCL), HarrisonKorn berg ARCHITECTS LLC making the CCL approximately $22,104,250. We also understand the project includes demolition of the existing Martin Luther King Jr. (MLK) Community Center located at 5565 Truman Dr. The HarrisonKornberg team has been selected as the most qualified team for the project, and this Proposal is offered in response to the City's request. Our Proposal is based on the project as described herein except that all services related to demolition of the MLK Community Center are excluded. If our understanding of the project scope is inaccurate or the project scope materially changes, we understand that our compensation will be equitably adjusted. Construction Project Delivery Method: We understand the Construction Project Delivery Method for this Project will be Construction Manager at Risk (CMaR). The Architect will become familiar with the site and scope of the Project. b. The Architect will consult with the City to clarify and define the City's requirements relative to the Project and review available data. c. The Architect will become familiar with the City's document "Facilities Division DESIGN GUIDELINES for New and Existing Facilities" and incorporate into all phases of the work. d. Create a Building Information Model (BIM), as required to serve as a background model for the design team to use in development of the Documents. Design Phase General: a. Perform services as described in this Proposal to complete the design and secure a construction permit. b. Prepare presentation graphics (plans, elevations, etc.) and present at two (2) City meetings (if required) during the design of the project. Design Development Phase: a. Prepare architectural, civil, iSWM, structural, and mechanical, electrical and plumbing (MEP) plans, principal elevations, site plans, cartoon set, and selection of principal equipment and finishes. Engage a Consultant to or self -prepare "Elimination of Architectural Barriers Registration" and submit the applications to the Texas Department of Licensing and Regulation (TDLR). c. Submit applicable documents to a Registered Accessibility Specialist (RAS) for TAS Review. Bidding & Negotiation Phase a. Provide such service as may be necessary for the building permits to be issued. b. Upload the electronic files in PDF format to the City's online bidding site. c. Respond to Contractors' inquiries and prepare necessary addenda. Construction Phase a. The Architect shall assist the City with review and approval of submittals and proposed change orders concerning the Contractor, and shall review and advise the City with respect to the resolution of construction issues, including Contractor Request for Information, Submittals, Change Orders, Contingency Allowance Forms, Field Orders, etc. b. The Architect shall visit the site at intervals appropriate to the stage of construction to become generally familiar with the progress and quality of the portion of the Work completed, and to determine, in general, if the Work observed is being performed in a manner indicating that the Work, when fully completed, will be in accordance with the Contract Documents. c. On the basis of the site visits, the Architect will keep the City reasonably informed about the progress and quality of the portion of the Work Completed and make written report to the City (1) known deficiencies from the Contract Documents and from the most recent construction schedule submitted by the Contractor, and (2) defects and deficiencies observed in the Work. d. Attend progress meetings. e. The Architect will conduct and document one (1) Substantial Completion inspection and assist the City on the resolution of construction or design deficiencies. Architect will issue AIA G704 Certificate of Substantial Completion with City approval. f. The Architect will review contractor's pay requests. g. The Architect will conduct one (1) final acceptance and one (1) end of warranty inspection with representatives of the City. h. The Architect will provide electronic copies of the drawings and specifications for the Contractor's preparation of "Record Drawings" for the City's archives. Assumptions 1. If construction services extend beyond 18 months from Contractor's Notice to Proceed with Construction to Final Completion, an equitable adjustment to the Architectural 1 Engineering Services Contract Sum will be made. 2. Owner document reviews will occur at 100% SD, 100% DD and 50% CD. 3. A topographic, boundary, and tree survey for this site will be required and will be provided to the Architect by the Owner in CAD format for our use and reliance in the design for this project. The survey should include a 3D surface compatible with Civil 3D, survey points and utilities on the site and adjacent to the site. 4. It is assumed that there are existing water and sanitary sewer lines adjacent to the site with sufficient capacity to serve the demands of this project. No off -site utility upgrades will be required and are not included in this proposal. HarrisonKorn berg ARCHITECTS LLC 5. Division 0 specification sections will be prepared, updated/revised as required, and provided to the Architect by the City of Fort Worth. The sections will be provided to the Architect in print ready format. 6. Organization of the Project Manual will be based on the current edition of CSI's MasterFormatTM. 7. The Architect will develop Building Information Model(s) (BIM) to a Level of Development (LOD) it deems appropriate for the scope of work described herein. 8. The Owner will provide a Utility Site Plan. 9. At the Owner's request, we have included Geotechnicai Services in our Scope of Work. Estimated fees for Geotechnical Services are included in the reimbursable expenses allowance amount indicated elsewhere in this Proposal. 10. The Owner will provide an approved vendor list (if not included in the Facilities Division DESIGN GUIDELINES for New and Existing Facilities). 11. The Owner will provide design criteria. 12. The project is not in the flood plain or other flood hazard area. 13. The Owner will provide structured cabling design. 14. The Owner will provide security systems design. 15. The Owner will provide AV systems design. * 16. We assume the property is already or will soon be zoned for the intended use. 17. The project will be bid and constructed as a single phase. 18. We assume construction progress meetings will occur no more than once a week during construction. 19. The project will have a maximum of seven (7) community engagement events. 20. If fast track production of any portion of the Contract Documents released for pricing/bid/ 21. fabrication or submitted for early site or building permit prior to such issuance of full design team documents is required, an equitable adjustment to the Architectural / Engineering Services Contract Sum will be made. * Infrastructure for items 13-15 is provided as part of the Architect's Scope of Work based on Owner provided designs. Exclusions 1. Preparation of Traffic Impact Analysis / Study and traffic control documents. We assume that these will be provided by the Owner, if required. 2. Preparation of traffic control plans for street lane closures, or sidewalk closures. We assume that these will be provided by the Contractor. 3. Commissioning services. 4. Cost estimating and Life -Cycle Cost analyses. We assume that these will be provided by the Contractor. 5. Surveying, platting, prepare and vacate easements, zoning, and any other property issues. We assume these services will be provided by the Owner. 6. All services related to demolition of the MLK Community Center. 7. Services of a Fire Protection Engineer (FPE). We assume that these services will be provided by the Contractor. The Architect will 1) provide fire sprinkler zoning, major routing, and performance requirement specifications, 2) provide layout of fire riser rooms and standpipe, 3) provide fire alarm device layout and system performance specifications, and 4) specify fire pump if required. Harrison Korn berg ARCHITECTS LLC 8. The A/E will investigate practical opportunities for sustainable design, but the project will not be designed to LEED, WELL or other similar requirements. LEED, WELL and similar Design, Documentation and Coordination can be provided as an Additional Service if required. 9. Structured cabling, security systems, and AV systems design and documentation is excluded. We understand that these items, including wiring, equipment, and associated appurtenances, will be designed by the Owner. 10. Facility Specific Business Plan. 11. Launch Operations Training. 12. Design of sanitary sewer and/or storm drainage lift stations or sumps, including pumps and appurtenances. 16. Performance of fire flow or sanitary capacity testing or hydraulic analysis of water services. 17. Stream hydrologic and hydraulic studies with computations for analyzing and determination of flood plains and channel improvements. 18. Underground storm water detention structures. 19. Platting, topographic, boundary, ALTA, deed and utility research, easement documents, tree survey or as -built survey for the site including Subsurface Utility Engineering (SUE) to determine the location of existing utilities. Update of survey of improvements after initial survey has been performed. It is our understanding that this information will be provided to the Architect by the Owner. 20. Materials testing. 21. Changes to the design documents required as a result of damage done to existing (utilities, pavement, flatwork, storm water management BMPs, etc.) by the Contractor or others. 22. Preparation of reports, permit applications and processing of permits for obtaining approvals. This includes permitting through local County agencies, State agencies (TCEQ), and federal agencies [i.e., FEMA-Flood Plain Letter of Map Amendment (LOMA)]. 23. Preparation of a Storm Water Pollution Prevention Plan (SWPPP) meeting the requirements of TPDES General Permit No. TX150000 and the local governing agency. 24. Payment of any and all plan review fees imposed by the City of Fort Worth, Texas or other agencies. ** ** The TDLR filing/administrative fee, TAS review fee, and TAS inspection fee is included in the Architect's proposed fee. 25. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to approve actions associated with execution of Amendment No. 2 to the architectural services agreement with Harrison Kornberg Architects LLC for The Hub, setting up some previously approved funding as a capital project, and amending the capital improvement program.. The Hub will be a new community center complex, located in the Stop Six community, that will include a multipurpose community center operated by the Neighborhood Services Department; an early learning facility operated by Child Care Associates; and a new aquatics center operated by the Park & Recreation Department. Project Funding_ Funding for the project includes voter -approved bonds from the 2022 bond program (community and acquatics centers), previously allocated American Rescue Plan Act funds (early learning facilitiy), and private donations as shown: Anticipated Funding Sources Amount Child Care Associates ARPA Funding (M&C 21-0814) $5,000,000.00 Fort Worth Housing Solutions Donation (M&C 22-0019): $877,500.00 Sid Richardson Foundation - $500,000 Amon G. A competitive procurement process for these services was conducted in accordance with Chapter 2254 of the Texas Government Code, with advertisement in January 2022, submissions in February, and interviews in March. More details of the selection process are contained in the document attached to this M&C. In order to expedite the project, City staff administratively executed an architectural services agreement with Harrison Kornberg Architects, LLC to provide illustrations to support the bond program in the amount of $12,000.00, with funding from the private donations. Amendment No. 1 was also executed using delegated authority in order to provide initial programing studies, in the amount of $80,538.00, for a total contract value of $92,538.00. Amendment No. 2 will provide the balance of architectural services for the design and construction administration of the project, for a total contract value of $2,199,969.00. Approval of the second recommendation appropriates the previously approved ARPA dollars (M&C 21- 0814) into a capital project, with the third recommendation formally amending the previously approved capital improvement program. Other Matters This project is partially funded from the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). The impact to operating cost associated with this project for the Neighborhood Services Department, beginning in Fiscal Year 2025, is expected to be $400,000.00 annually. In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non -City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived." M/WBE OFFICE — Harrison Kornberg Architects LLC is in compliance with the City's Business Equity Ordinance by committing to 27\% Business Equity participation on this project.
