That Section 1 of Ordinance .Memo. 4366, passed and adopted by the City Council of the City of Fort Worth, Irexas, on Friday, September 9, 1960, be amended, and after beinE. so fannended, it shall read as follows: SE,0PIOTT 1. "That the City Council of the City of Dort Worth, in the exercise of its sound discretion, deems it necessary and finds that public necessity requires that storm drains, drainage ditches, Laterals and appurtenances thereto be constructed and maintained 3n, through, over, along and across a portion of the J. E3, IlcDerana,Itt Survey, Abstruct I%Io. 1063, in Tarrant County, "Texas; and that public necessity requires, in making such permanent improvements, that an easement be acquired for the construction and maintenance of same in, through, over, along and across property belonging to or claimed by the fol- loving persons: Aaron Rashti and George Rashti, by warranty deed from L. C. Wright dated September 30, 1955, filed Septem- ber 30, 1955, and recorded in Vol. 21)12, page 393, Deed. Records of Tarrant County, Texas;„ L. C. Wright, by deed of trust from: Aaron Rashti and George Rashti dated September 30, 1955, filed September 30, 1955, and recorded. in Vol. 1222, page 505, Deed of Trust Records of Tarrant County, Texas, and I. M. Levy, by contract of sale from Aaron I;ashti and George Rashti to the said I. M. Levy, dated, October 10, 1955, .filed February 25, 19581, and recorded in Vol. 3,,1434, page 671, Deed Records of 'Tarrant County, Texas, the location of the centerline of such storm drain easement being described more particularly as follows: Beginning at a point in the J. B. McDennatt Survey, said point being 5,192.7 feet east and 1,184.9 feet south of the northwest corner of said survey, and said point also being on the north line of the Gulf, Colorado and Santa Fe Railway right of way, and proceeding north 46 degrees 1(8 minutes vest with the base line of said easement (with limits being 10.0 feet to the left and 10.0 feet to the right) a distance of 'fO.O feet to a point; 'hence north ! de,@?,rees, 13 minutes west with the base line of said easement (with limits being 27-5 feet to the left and 37.5 feet to the right) a distance of 230.0 feet to a point; Thence proceeding north ?6 degrees 18 minutes west with the base line of said easement (with limits being 24.5 feet left and 34.5 feet right) a distance of 300.0 feet; Thence proceeding along, a curve to the right, which. center bears north 43 degrees 4P minutes east and radius equals 1,000 feet"with the base line of said easement (with limits -being 21.0 feet left and 31.0 feet right) a distance of 396.0 feet to a point; Illience proceeding along a 1,000 foot radius curve, -which center bears north 69 degrees 23 minutes east with the base line of said easement with limits being 13.5 feet to the left and 23.5 feet to the right, a distance of 200 feet to the end point of said easement, and con- taining 1.449 acres more or less., such drainage easement to be acquired to be sufficiently vide to construct and maintain therein a storm, dip ditch approxirw%tely eight (8) feet in width at the t des sloped at a o ratio of one and one-half (1-1 (MMInIl ) with a m ay-ilTium depth of twelve and one-half (12-1/2) feet, all as more particu- larly shown on Exhibit "A" attached hereto and expressly incor- porated herein as a part of this ordinance. "That the above described drainkgre easement is hereby estab- lished and confirmed by the (',ity Ccnvacil of the City of Fort Worth as a public drairap ge ea"=ent in, through, over, along and across that portion of t1ie J. B. McDermott Sarvey, Abstract No. 1063, in Tarrant County, Texas, all of which is more particularly shown on P aibit "A" attached hereto and e�,I)ressly made Lt part hereof." SE Should any part, section, siabsection, paragrraphiL, sentence, clause or phrase contained in this oxLUaance be held to be unconstitutional, such holding shall not affect the validity of the remattyIng portion thereof, but in all respects said remaining portion shall be and remain in full force and effect; and the City Council hereby declares that it would not have passed the unconstitutional part had it known it was invalid and that it 'would have passed the remaining part that is not invalid. SECTI% 3. Mat this ordinance shall be cumulative of all other ordinances of the City of Fort Worth with respect to the construction and maintenance of on adequate system of storm drains, drainage ditches, laterals and appur- tenances thereto, except in those instances were the provisions of this ordinance are in conflict with the provisions of any prior ordinances, in vhich instances the provisions of this ordinance shall prevail and those provisions in prior ordinances in conflict herewith are hereby expressly repealed. m That this ordinance shall be in full force and effect from and after the date of its e, and it is passage, , so ordained. OFFICE OF THE CITY MANAGER Communication to Mayor and Council No. PWI- 63 February 17, 1961 11, kR Honorable Mayor and Members of the City Council Re: Wedgwood Storm Drain at Hulen City of Fort Worth Street, Easement from Aaron Rasht'i , Project 94 C 14 Mrs. McKnight and Gentlemen: On August 26, 1960, authority was granted to institute eminent domain proceedings to acquire the channel easement required for the above pro- ject. Subsequently the City Council , on October 28, 1960, approved an alternate agreement which later the owner would not accept. The descrip- tion for the easement was changed slightly for the alternate agreement to permit relocating a section of culvert. It is recommended that the City Council adopt an amendment to the ordinance adopted August 26, 1960, granting the City Attorney authority to institutue eminent domain pro- ceedings based on the Channel easement description as included in the last offer to the owner.
