AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON PORTIONS OF GOODMAN AVENUE AND PORTIONS OF SUNDRY OTHER STREETS AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS, FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED, DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING, AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THIS CITY. WHEREAS, the City Council of the City of Fort Worth, Texas has heretofore ordered that each of the hereinafter des- cribed portions of streets, avenue and ,public places in the City of Fort Worth, Texas, be improved by raising, grading and filling same and by constructing thereon a 6 inch Hot Mix Asphaltic Concrete Surface on a treated subgrade, with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances, as and where shown on the Plans and in strict accordance with the Plans and Specific- ations therefor; and contract therefor has been made and entered into with Texas Bitulithic Company; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: Section 1. Such estimates be, and they are hereby, adopted and approved. SECTION 2. It is hereby found and determined that the cost of im prove- ments on each portion of street, avenue and public place hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to wit: On GOODMAN AVENUE: from the West line of Hervie Street to East line of Bourine Street, known and designated as Unit No. l: the estimated cost of the improvements is $11,962.40; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated - 1 - amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $5.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $7.13. On GOODMAN AVENUE: from the West line of Prevost Street to West line of Hervie Street, known and designated as Unit No. 2: the estimated cost of the improvements is $12,058.98; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $5.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $7.13. On LIBBEY STREET: from West line of Prevost Street to East line of Hervie Street, known and designated as Unit No. 3: the estimated cost of the improvements is $11,418.78; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $5.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $7.13. On ELIZABETH LANE: from East line Lackland Road to the West line of Texas Boulevard, known and designated as Unit No. 4: the estimated cost of the improvements is $23,454.00; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On N. W. 28TH STREET: from the North line of Titus Street to the South line of Sherman Street, known and designated as Unit No. 5: the estimated cost of the improvements is $8,854.54; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On N. E. 10TH STREET: from the East line of Samuels Avenue to the West line of the Gulf, Colorado & Santa Fe Railroad right-of- way, known and designated as Unit No. 6: the estimated cost of the improvements is $8,228.38; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. 2 On N. W. 25TH STREET: from the South line of Titus to the Worth line of McCandless Street, known and designated as Unit No. 7: the estimated cost of the improvements is $9,771.99; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On YOSEMITE COURT: from the South line of Yosemite Drive to the North line of Shelton street, known and designated as Unit No. 8: the estimated cost of the improvements is $8,567.50; the e stimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On McKENZIE STREET: from the South line of Avenue "J" to the North line of Avenue "K", known and designated as Unit No. 9: the estimated cost of the improvements is $3,756.05; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On BRADLEY STREET: from the South line of Texas & Pacific Railroad Company right-of-way to North line of East Rosedale, known and designated as Unit No. 10: the estimated cost of the improve- ments is $15,610.89; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On BONNIE DRIVE: from the South line of Slocum Street to a line drawn perpendicularly across Bonnie Drive from the Northeast corner of Lot 9, Bloch. 32, Alta Mere Addition, to the Northwest corner of Lot 6, Block 31, Alta Mere Addition to the City of Fort Worth, Te xas, known and designated as Unit No. 11: the estimated cost of the improvements is $35,647.95; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $5.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $7.13. 3 On EAST RIPY STREET: from the West line of May Street to the West line of South Main Street, known and designated as Unit No. 12: the estimated cost of the improvements is $7,548.80; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the e stimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof , is $6.13. On OWASSO STREET: from the North line of Byers Street to the South line of Lafayette Street, known and designated as Unit No. 13: the estimated cost of the improvements is $13,249.51; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On BRYCE STREET: from the East line of Dorothy Lane to the West line of Owasso Street, known and designated as Unit No. 14: the estimated cost of the improvements is $4,740.39; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On SAPPINGTOIT PLACEr, . from the South line of Calmont Street to the North line of Locke Street, known and designated as Unit No. 15: the estimated cost of the improvements is $11,341.24; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On LLOYD STREET: from the South line of Avenue "H" to the North line of Avenue "M", known and designated as Unit No. 16: the estimated cost of the improvements is $26,532.63; the e stimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On SYDNEY STREET: from the South line of Tarrant Road to the North line of Forbes Street, known and designated as Unit No. 17: the estimated cost of the improvements is $10,066.09; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the - 4 - estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On DEXTER STREET: from the East line of Dorothy Lane to the West line of Montgomery Street, known and designated as unit No. 18: the estimated cost of the improvements is $13,428.25; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On SHELTON STREET: from the East line of Canton to the West line of Oak Hill Street, known and designated as Unit No. 19: the estimated cost of the improvements is $10,676.94; the estim- ated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $4.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $6.13. On PECOS STREET: from the East line of Shackleford to the West line of Trentman Street, known and designated as Unit No. 20: the estimated cost of the improvements is $20,274.18; the estimated amount per front foot to be assessed against abutting property and the owners thereof for curb and gutter is $1.70; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $5.43; total estimated amount per front foot to be assessed against abutting property and the owners thereof is $7.13. SECTION 3. A hearing be given and held by and beffore the city Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of streets, avenue and public places, as well as to all owning or claiming any interest in an such property. Such hearing shall be given and held on . M., the day of 77 i �tt,cA_ 1961, at 6,L, o'clock, L. in the council chamber in the City Hall in the city of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the state of Texas, and known as Chapter 106 of the Acts of said Session, now being shown as Article 1105b of Vernon's Texas Civil Statutes. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least ten days before the date of said hearing. Said notice shall comply with and be in accord- ance with the terms and provisions of said Act. The City Secretary - 5 - is further directed to give personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of streets, avenue and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice, postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest irl said properties, to the last known address of said owner or persons. It shall not be necessary for the City Secretary to mail said notice to any owner or other person claiming an interest in the property to be assessed when the address of such owner or other person is unknown to the City Secretary and cannot be determined by the City Secretary after reasonable investigation. In this connection, the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known to him, was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary shall be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in nowise invalidate said hearing or any assess- ments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been given by newspaper advertisement as first hereinabove provided. SECTION 4. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate ordinance Records of this city. SECTION 5. This ordinance shall take effect and be in full force and effect from and after the date of its passage. APPROVED AS TO FORM AND LEGALITY: City Attorney.
