Ordinance No. 17197-09-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS iN THE WATER CAPITAL PROJECTS FUND 1N THE AMOUNT OF $695,376 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREI=MENT WITH KIMLEY HORN & ASSOCIATES, INC. FOR THE NORTHSIDE 1112.5 Mll-LION GALLON ELEVATED STORAGE TANK AND 36" WATER TRANSMISSION MAIN; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES 1N CONFLICT HERI=WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $695,376 from available funds far the purpose of fiunding an Engineering Agreement with Kimley Harn & Associates, Inc. for the Northside !il 2.5 Million Galion Elevated Storage Tank and 36" Water Transmission Main. SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative ar void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to transfer $695,376.00 from the Water and Sewer Operating 1=und to the Water Capitai Projects Fund; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $695,376.00 from available funds; and 3. Authorize the City Manager to execute an engineering agreement with Kimley Horn & Associates, Inc. far a lump sum fee of $648,500.00 far the Narthside ill 2.5 Million Gallon Elevated Storage Tank and 36" Water Transmission Main. ©ISCUSSION: On March 19, 2002, (M&C C-19013) the City Council authorized the execution of an engineering agreement far the update to the Water System Master Plan. This study provided schedules far major water capital improvement projects through the year 2025. The update to the water master plan contains projections far both population growth and corresponding potable water demands of each pressure zone within the Water Department's service area, including the rapidly growing Northside service area. The Water Master Plan recommended that a 2.5 million gallon elevated storage tank be constructed to provide service to the Narthside III pressure plane along with the installation of a 36-inch water main, connecting the proposed elevated stnrage tank with the existing 36-inch line located at the intersection of Willow Springs and Avondale Haslet Road. The proposed elevated storage tank will be located near the intersection of Avondale Haslet Raad and U.S. 287. As part of the scope of work within this agreement, the Engineer will assist in the acquisition and platting of the elevated storage tank property, assist in the acquisition of a building permit fnr the elevated stnrage tank, perform all engineering and design functions necessary for the preparation of plans and specifications fnr the elevated storage tank project and the pipeline project, provide construction estimates, provide bidding services and shop drawing review, and perform the construction management far the construction of the elevated storage tank. In addition to the contract amount, $46,878.00 is required for project management by the Water and Engineering Departments.
