HomeMy WebLinkAboutOrdinance 26024-02-2023 ORDINANCE NO. 26024-02-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STREET IMPROVEMENTS 2008 FUND, IN THE AMOUNT OF$500,000.00, FROM AVAILABLE FUNDS,FOR THE PURPOSE OF FUNDING THEWICHITA ST. WIDENING ILA PROJECT (CITY PROJECT NO. 104743); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Street Improvements 2008 Fund in the amount of$500,000.00,from available funds,for the purpose of funding the Wichita St.Widening ILA project(City Project No. 104743). SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize execution of an Interlocal Agreement with City of Forest Hill in the amount of$500,000.00 for the Wichita Street Widening project (City Project No. 104743); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements 2008 Fund in the amount of$500,000.00,from available funds,for the purpose of funding the Wichita Street Widening ILA project(City Project No. 104743); and 3. Amend the Fiscal Years 2023—2027 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C)is to authorize execution of an interlocal agreement(ILA)with City of Forest Hill and to appropriate funding to allow City of Fort Worth to pay City of Forest Hill the amount of$500,000.00 for improvements to Wichita Street. The 2022 Tarrant County bond program called for the widening and reconstruction of Wichita Street from an existing 2-lane asphalt roadway from Interstate Highway-20 south to Roy Brooks Boulevard to a 5-lane undivided curb and gutter roadway with a continuous median tum-lane. Improvements will include enhanced drainage to the north fork of South Creek and South Creek crossings with an enclosed stormwater system to minimize current flooding conditions,traffic signalization, illumination and a 10-foot shared-use path. A portion of Wichita Street,from 340 feet north of Alta Mesa to 960 feet south of Joel East Road, lies wholly within the City of Fort Worth's city limits("Fort Worth Segment")which is designated on the City's Master Thoroughfare Plan and other relevant planning documents and is subject to Fort Worth design standards. City of Forest Hill has entered into an Interlocal Agreement with Tarrant County to manage and deliver the project with Tarrant County providing funds up to the amount of$11,100,000.00 toward the construction cost of the project. Holt Lunsford Commercial,Inc.plans to develop land within City of Fort Worth which will access Wichita Street. Holt Lunsford Commercial, Inc. has entered into a separate agreement with City of Forest Hill to provide$2,390,000.00 toward the cost of the project,to be used on the Fort Worth Segment. The table below illustrates the funding amounts by entity for the project: Entity Funding Amount Tarrant County $11,100,000.00 City of Forest Hill(via developer contribution) $2,390,000.00 City of Fort Worth $500,000.00 Project Total $13,990,000.00 Tarrant County has contracted with DEC-North Texas, LLC to perform and provide the design and engineering work for the project. City of Forest Hill will be responsible for procuring and managing the construction phase of the project once plans are complete. Funding for this project was not included in the Fiscal Years 2023-2027 Capital Improvement Program because ILA negotiations had not begun at the time of the CIP development. The actions in this M&C will amend the Fiscal Years 2023-2027 Capital Improvement Program as approved in connection with Ordinance 25773-09-2022. Funding is available in the Unspecified-All Funds project within the Street Improvements 2008 Fund for the purpose of funding the Wichita St. Widening ILA project. This project is located in COUNCIL DISTRICT 8/Future COUNCIL DISTRICT 8. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:City of Forest Hill FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified-All Funds project within the Street Improvements 2008 Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the Street Improvements 2008 Fund for the Wichita St.Widening ILA project to support the approval of the above recommendations and execution of the intedocal agreement.
