AMENDMENT NO. 3
TO
CITY OF FORT WORTH CONTRACT 55861
This Amendment is entered into by and between the City of Fort Worth (hereafter
'Buyer"), a home rule municipality, with its principal place of business at 200 Texas Street, Fort
Worth, Texas, and Consolidated Traffic Controls, Inc. ("Vendor"), Buyer and Vendor may
be referred to individually as a Party and collectively as the Parties.
WHEREAS, on July 12, 2022, the Parties entered into City Secretary Contract 55861 to
provide School Zone Beacon Communication Modems, Traffic Signal Parts and other Related
Hardware and Equipment ("Agreement/Contract");
WHEREAS, the Parties wish to amend the Agreement to include additional federal
compliance terms;
WHEREAS, the Parties wish to amend the Agreement to increase the contract
compensation amount by $600,000.00 for a new total annual amount not to exceed $1,000,000.00.
NOW, THEREFORE, the Parties, acting herein by the through their duly authorized
representatives, enter into the following agreement:

AMENDMENTS
The Contract is hereby amended as follows:
Total payment under this contract, on an annual basis, shall not exceed
$1,000,000.00.

ALL OTHER TERMS SHALL REMAIN THE SAME
All other provisions of the Agreement which are not expressly amended herein shall
remain in full force and effect.
3.
ELECTRONIC SIGNATURE
This Amendment may be executed in multiple counterparts, each of which shall be
an original and all of which shall constitute one and the same instrument. A facsimile copy
or computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall
have the same effect as anoriginal.

Council Cooperative Contract PE05-21 for the Transportation and Public Works Department (2022 Bond Program)
RECOMMENDATION:
It is recommended that the City Council authorize execution of an amendment to City Secretary Contract No. 55861 with Consolidated Traffic
Controls, Inc. for RTC School Flasher Systems to increase the annual amount by $600,000.00 for a new annual amount not to
exceed $1,000,000.00, using Houston -Galveston Area Council Cooperative Contract PE05-21 for the Transportation and Public Works
Department.
DISCUSSION:
The Transportation and Public Works Department (TPW) requested that the Purchasing Division assists with amending an agreement with
Consolidated Traffic Controls, Inc using Houston -Galveston Area Council (HGAC) Cooperative Contract PE05-21 to increase the not to exceed
annual amount by $600,000.00 from $400,000.00 to $1,000,000.00.
On February 5, 2019 Mayor and Council Communication (M&C) P-12296 was authorized by City Council to enter into a purchase agreement with
Consolidated Traffic Controls, Inc. for RTC School Flasher Systems in an annual amount of $300,000.00. Amendment No. 2 was executed July 12,
2022, increasing City Secretary Contract (CSC) No. 55861 to an annual amount of $400,000.00 using the administrative change order provided
by this M&C. The Transportation and Public Works Department is now in need of an additional $600,000.00 increase.
The increase will be used to purchase School Zone Beacon Communication modems, traffic signal cabinets, audible pedestrian system,
Emergency Vehicle preemption system, and other related traffic control hardware and equipment to make necessary upgrades, repair, or bring the
traffic control devices up to standard and compliant with the latest industry requirements.
The maximum amount allowed under this agreement citywide will be $1,000,000.00, however the actual amount used will be based on the need of
the department and the available budget.
Funding is budgeted in the TPW Dept Highway & Streets Department's 2022 Bond Program for the purpose of funding the TPW 2022 Bond
Traffic Signal project and in the General Capital Projects Funds for the purpose of funding the FY 2023 PayGo Traffic Signal project, as
appropriated.
This is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022)
provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is
issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022).
State law provides that a local government purchasing an item under a cooperative purchase agreement satisfies any state law requiring that the
local government seek competitive bids for the purchase of the item. BuyBoard contracts are competitively bid to increase and simplify the
purchasing power of government entities across the State of Texas.
A M/WBE goal is not assigned when purchasing from an approved purchasing cooperative or public entity.
These projects will serve ALL COUNCIL DISTRICTS.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the 2022 Bond Program Fund
for the TPW 2022 Bond Traffic Signal project and in the General Capital Projects Fund for the FY 2023 PayGo Traffic Signal project to support the
approval of the above recommendation and execution of the amendment to the contract. Prior to any expenditure being incurred, the
Transportation & Public Works Department has the responsibility to validate the availability of funds.
